I was wondering if someone can help me here..When you guys says 180 days after receipt date does that mean I have to have 6 paystubs from the company who sponsered my GC ? Let explain my situation...
I was working for company A and Company B sponsered my GC and I my 485 receipt date Aug152007 and started working for B from Nov12007 and as of now with B...I want to move back to A from March12008 but someone was mentioning U need 6 paystubs to show that u have stayed 180 days is this true ?
Any info on this wud be appreciated.

Congratulations.....I'm in a similar boat. My parent's visa was rejected twice (last year and this year) at Mumbai. Did you go through any consultant this time? I'm planning to send my parents again but before they are planning to go for a foreign tour.

My friend faced the same issue when he was leasing a 2010 Nissan. He was given loan / lease only till validity of his H1B. Seems like its new thing do some financial institutes have taken this mandate seriously the other will follow eventually. Looks like H1B and home loans will soon be history.

I came here last year with a different company H1. I dont have any problem with the current employer but the company i am working is a direct client to American Business Solutions. Due to this they approach me to join them.

In any event, my guess is that there�s a lot of legislation that wouldn�t fare very well if submitted to the kind of scrutiny the House is about to give the Senate bill.
For this reason, I�m guessing this tactic of pre-conference hearings won�t be often repeated. But now that it�s been unleashed, who knows how and when it will be used again?

I did not know 40-50% indians were in that age group. This is Huge, India will come back in every sphere, because of this statistic alone. outsourcing is only a drop in the ocean when you look at these numbers. These numbers "may" also mean that about 20-30% population in the world for people around age 25 would be Indians.
The Basic problem still remains (Roads, Water, Electricity, Sewage) and the root cause is corruption at all levels.

I also have EB3 ROW and considering moving to another employer to file EB2 before the CIRcus train came around! The only problem now is that nobody knows what will happen to applications filed after May 2007. Until that ambiguity is resolved I am staying put with my current EB3 approval.
Is it safe to assume that everybody that posted here, is from India, and would remain retrogressed after the job change?
I'm asking, because I have EB3 ROW PD date of March/06 and I'm considering changing jobs and apply for EB2. Since EB2 ROW is not retrogressed, I'm hoping I can get my green card before Oct/08, with concurrent filling of I-140 and I-485. My H1B is good till 2010 (3 year extension approved with current company, just need to stamp it).
So my question for my fellow gc applicants from India, if you could switch jobs and apply to a category that was not retrogressed, would you do it?

my attorney said I had some misconceptions about labor certification and its totally an employers petition for a open and cannot be changed/modified to meet the affordable salary the employer can pay
They attorney asked my employer to give the description of job and the salary offered to it. attorney said if they meet requirement the case can be filed otherwise its not possible to do the case
employer stufied the job requirements, and then offered 92K which put the job into eb2 level 4.

Hello all,
I just wanted to share you a good news. My ead is set to expire on Jan 15,2009. I applied for EAD renewal after reading a lot of horror stories for renewal on this site and other sites. I applied on Sept 24,2008 (paper filed with lawyer) and posted that on the same day.
The RD for it is on 25 sept,2008 and I received CPO on 30 sept,2008
Here is my question to Gurus. did the new database create wonders for US(CIS)?

One of the reasons for careful inspection of the PPD site, and clear distinction concerning swelling vs. induration is that we have found many Applicants from India, Sri Lanka, and other areas of South Asia who exhibit either a swelling or a positive reaction. A POSITIVE REACTION MAY ALSO BE THE RESULT OF PRIOR 'BCG' VACCINATION IN THE HOME COUNTRY. BCG IS 'BOVINE CHORIONIC GONADOTROPIN' and is frequently administered in those areas as a preventative. BCG will CROSS REACT WITH THE ANTIGEN TO TUBERCULAR ANTIBODIES AND RESULT IN A 'FALSE POSITIVE' RESULT! Tell the Civil Surgeon if you have had BCG Vaccination in the past.
Today, if such is the case, we recommend to the Applicant that they undergo the IGRA tuberculin test rather than the PPD. There is one bad thing about house bill, license expires at end of status (maybe).
I had hoped that we could try to get 180 day grace period, but between being worn out (too many 3am and 4am nights), more letters needed, and seeing overwhelming forces coming into play, we were not able to put enough effort into that.
There were 4 possible outcomes that I could see:
1) No license (the question was how long this would stand)
2) Senate bill 962 (very bad, I think we helped sink this)
3) House bill 4505 (only bad thing is expires with status, but may have loop holes)
4) House bill 4505 amended with a grace period.
I think there might be potential favorable loop holes in house bill 4505 (thus the 'maybe'), much will depend on SOS rules. I think that it was great that we helped to shift momentum to option 3 because options 1 and 2 really stank. Given the MI politics as explained to me by local insiders, it is double great that we helped shift momentum to house bill 4505 and away from senate bill 962, and away from status quo.
As part of chasing members of Congress for letters this week, I had mentioned MI DL to a staffer in DC. She was already aware of the mess (while being unaware of our GC issues). When staffers in DC think you have screwed up you probably ought to do something about it. That is when I realized there were overwhelming forces driving things and option 4 would not have time for consideration. Also a Dem Staffer in MI that I spoke with had already tried for a grace period (someone who understood the system), and she said words to the effect of 'talking to a brick wall' (my Brit phrase).
But I did not expect resolution this quickly! If I had to bet, it would have been for next week or week after. My guess was that there would be a race between law suit outcome and legislature, and that gave legislature at most two more weeks before a judge would likely grant an injunction. I think that the complaint that ACLU filed was robust and compelling and importantly not complex making it harder for SOS to fight. I would have been shocked if an injunction was not granted (although the response to the complaint had not been filed), although a judge could delay judgment while legislature made its mind up.

Few years back my parents visa was denied becos the sponser who is family friend was not sound financially. Now 2 months before my sister who is now permanent resindent of USa and have very solid finaces sponsered my parents to visit her and attend the graduation ceremony (high Scool) of their grand daughter. We deposited fees and as we have few days I contacted us state dept by email telling them about garduation and asked for emergency interview ( our relative got it with same reason 4 monts back) and they replied positively after 5 days asked for details of parents. Meanwhile after waiting few days after fee receipy activated and with no reply from state dept i tried to get a appiontments by VFS in punjabi but there was no date in Punjabi. Then I read somewhere that If we book interview in English when we get emergency interview we can request change of languge from english to Punjabi. Later the state dept refused saying that they give emergency interview for death and medical emergencies. then I requested them to change meidum of interview i got no reply.
Then My parent go through demo interview and perpared well. they were not easy with english but they wanted to give it try. Due to acsecnt my mother did not under stand what Vo was asking but father replied 4 question well. then on fifth question he did not got it and asked to repaeat telling that his english is weak. VO repaeted but then also he did not understand and asked to ask again then she (VO) statred long and denied visa.
Now my father want to try iaging next week in punjabi and my mother decided to try after if my father get visa. Any advise or suggestions? Is this thing that my father alone is appling positive or negative please suggest.
