It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.
When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.
(1) After applying online, you will receive 'Receipt notices' of EAD & AP.
(2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
(3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.
Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.

Can we all take a month from his list of trancscripts and read through his transcripts and see which one has the H1B mistatement. I think he said this sometime in 2005 or 2006 we only need 24 participants.

I am in the same boat. My employer decided to file my case under EB3. For that, even the job position was in such a way that required only EB3. I had 7 years experience at that time. So it could have been EB2. That is fine, I am not sad about it.
My question is, since the original position had requirements that met EB3 and not EB2, how can you now justify moving to EB2 within the same company and for the same position?
You can't move to EB2 if both employer and position remain the same. I was promoted after working with them for 3 years!:rolleyes: Plus I have a Masters in Computer Science. My new position required more experience and a Master's Degree, hence qualified for an EB2.
Similarly, you can change employers and look for a better job. Then you can use the experience gained at the previous employer. But, ALWAYS, the job requirement has to state the need for years of experience or Advanced degree.

please ignore the dots...the important thing is to make the lawmakers aware of the issue. As mirage mentions we should send a letter to the rep Logfren, (i have mailed the letters), we just want them to be aware that there is an issue, ROWs please send them too, you will also be impacted. Nothing against EB2's or the comments they have passed so far, we dont want to undermine your visas, the idea here is simply to make the lawmakers and DOS/USCIS aware of the problem.
In a way DOS/USCIS have opened a pandoras box because EB3 as a whole will see slower approvals leading to a larger number of countries stuck in the process across a spectrum of countries. earlier it was mainly india, china and mexico. If visa allotment policy holds then you will see more countries getting retrogessed.

After we landed, the passengers were asked to exit the aircraft along with their carry bags. Many of us were puzzled as some of us wanted to catch up with our sleep. Reluctantly everyone had to leave the aircraft. Someone was saying there is another aircraft waiting to take us to India. Makes sense, that is why they asked us to take our cabin bags too. After we entered the building we were asked to take the left door. Behind the right door was a waiting room. A couple of turns led us into a corridor which was probably about 1/2 mile long. At the end of the corridor there was security check. Again I was puzzled, why security check now, we are already in a secure area. The transit visa form with those 111 questions suddenly came in front of my eyes. Nothing less than a new complete security check will satisfy these neurotic people. It was time to go thru the exercise again. Took off the shoes, wallet, coins, Jacket, belt, pants .... when I was gently reminder by the security guard that it was not required today. When my turn came to send the items thru the machine, I complained about the fact that I have to put my jacket in a bin that was probably used earlier to keep someone�s shoes. (And you know where the shoes go. And sometimes when it gets wet, it is not necessarily because of water. The thought itself was so revolting that I decided to get my jacket dry-cleaned after I reached India). Needless to say my protest landed on deaf ears. After going thru the security gate, it was time to go thru the final check. I assumed the flying eagle's position and was quickly scanned and cleared. Beyond the security point was the shopping and restaurant area. I was bit thirsty but could not force myself to spend on a bottle of water. I was so put off by this whole experience that I did not want to spend a single cent here. We looked at the monitor to find our gate and quickly proceeded towards it. Again we walked for about half a mile or so. Things looked familiar, but I quickly brushed off the idea. At the gate we presented our credentials and were admitted into the waiting area. Then again I got a sense of d�j� vu. I soon realized it was the same freaking waiting room that I saw earlier and the same aircraft was waiting for us. We needlessly walked for more than a mile, subjected ourselves thru security check. All this for what?
After waiting for an hour we were allowed to go into the aircraft to the same seats and surrounded by the same little pieces of garbage still on the floor. I congratulated myself for not buying the water bottle and looked out of the window to say final goodbye to London. Never again! Never.
Brit's think they are born twice & superior to the world and they can do better job in security checks then Americans....or as a matter of fact then any one else in the world?
I am not saying there shouldn't be any security checks but one thing is not clear or don't understand why do we have to go through security check process when nothing has could have changed in between flight take off from US and landing at Heathrow airport..I feel the possibility of someone getting into flight after its take off is ZERO chance....
What irritates me is when I travel through AIR-INDIA (proud passenger since 2001) stopover at London is right in the middle of night..you will be in deep sleep when it stops in London for fuel refill or some s*$^ we have to get down from plane and go through security check..it's so annoying I don't know when these security checks/stunts will STOP!!

USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.
But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?

My wife and I are planning to apply as dependents for each other.
Reasons:
My company is doing so-so.
On the other hand if and when we have kids, she would like to stay at home if possible.
The only thing that is not clear is we probably should file only 1 EAD/AP.
For now, we are thinking we will apply for EAD/AP through her I140.

I-693, supplemental I-693 (vaccination record) , copy of enclosed documents, blood tests (HIV) , skin test results( BCG), your acceptance for these tests, x-ray report (if skin test is very positive - see belwo) and TB diagnosis ( no TB) is enclosed in the sealed envelope. In original.
The same set is given to you. The medical staff with go through section by section and show it to you (in your copy) that all sections are completed ans signed. If you take vaccination on the first day, then on the third day they will give you sealed cover. [LIST=1]

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

No more 1 year multiple entry TV. I was issued only 2months multiple entry with visa expiring just after 15 days of my return.
With all due sympathies, this is one of the funniest posts I have read in a long time....It helps to lighten up a bit every now and then considering we are all in this for a long haul...
Anyway, just wanted to let you know that I went through London back in 2004 and my experience was completely different. I went to the NYC consulate to get my TV for $50, yes just $50 and the whole paper work etc was done in less than 30min and I had to go back after 2 hours to collect my passport with a 1 year multiple entry stamped on it.
My point being, I think they have changed a lot of rules and made it more stringent after the recent security threats etc.
Getting a GC soon is our saviour

To folks waiting for the magic email...hang in there....your time will definitely come. In the meantime, do all you can to ensure that USCIS closes out your case (such as SR, emails, congressman, etc.). In my case, the first four working days of August were very difficult...as it's very hard to sit around and not do anything. I did open an SR by calling USCIS on the 5th, but I am not sure if it mattered since we received the magic email the very next day.

Hi GC ON DEMAND, I think you are right... Looks like we did not receive any spill over from EB1 and EB2 ROW --- Here are the calcs...
Regular EB2 ROW gets 34,436 -- see below for break down
We know that EB2 gets 140,000 * 28.6% of visas which is 40,040.
Out of 40,040, 7% is allocated to china and an other 7% goes to India.
So EB2 ROW = 40,040 - 2*(40,040*7%) = 34,436 -------------------------------------------- (1)
In the document that you have, EB2 ROW received 27, 406 visas... How? see below
Total allocation for Eb2 (A1) - 53,872
India received (B1) - 19,961
China's received (C1) - 6,505
-------------------------------------------------
EB2 (ROW) net = A1-(B1+C1) = 27,406 -------------------------------------------------------- (2)

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
