You can do three things.
Try in this order
1) Fill DHS7001 and send it to the ombudsman's office. You will get an answer in 30 days from the USCIS customer service.
2) Contact the local senator. Go online and get their phone no. You can choose a dem or repub. Then call just one. They will send in a form to fill. Then you wait
3) Writ of Mandamus. If all fail try this on your own (or else hire a lawyer $3000 min). All of the above efforts will add to your case.
Dont try InfoPass since they have no clue what happening with your case. They are just like the customer service. They will help if there is some issue with EAD, AD Paro, or Fingerprinting not on processing delays.
Calling customer service is also useless. They offer no help at all.

1) If I were you, I would do a H-1 transfer to new employer rather than use my EAD, assuming you have enough time on your H-1. You may or may not let USCIS know that you are porting off. If you dont let them know, I believe, right before they approve your 485, they will send a RFE asking for employment verification. At that time you can send employment letter from your new employer.
2) Filing AC-21 does not require any sponsorship. All the new employer will have to do is a) H-1 transfer b) use same ONet code as your L.C., check your LC and you will find this code. c) willing to provide employment verification, as and when USCIS needs it. d) basically support you at least until you get your GC. f) Oh the pay should not be outrageously high or low

I am currently working on H1B with a consulting firm and my wife and my 5 year old son are on H4 visa and staying with me in US. I have applied for I-485 in Aug-2007 (for all 3 of us) and I got my I-140 approved in Dec-2006 through my current employer. I got EAD for my wife and myself in Oct 2007. As I have well passed 6 months limit, I am planning to change my employer. I am getting an offer for a full time position job with a new employer and my job profile is similar to what it was while I applied for Labor approval. I am planning to use EAD for new employment, as my new employer does not sponsor H1B. Here are my queries.
1. Is it safe to start working on EAD? I can submit AC21 for change of employer.
2. Does filing AC21 require any kind of sponsorship from my new employer? Can I do it my self without any involvement from new employer (except offer letter and pay stubs from new employer)?
3. Do I need to hire a lawyer for filing AC21 or I can do it my own personally?
4. Is there any time limit within that I need to submit AC21 after joining new employer?
5. As my H1B status will go off as soon as I use EAD and my wife and son will also loose H4 status. For my wife she can be on EAD but what about my son as I think any child below 18 years cannot have EAD? On which status he will be?
6. Although this is not an option for me right now but what if my new employer transfers my current H1B and I keep working on transferred H1B (don�t use EAD) with new employer, do I need to submit AC21 in this case also, as my old company will not entertain my I-485 processing?

My new company as well as old company both are fortune 500 companies and both are in same business and my job duty is also the same.
I could understand from the company's prospective that they might be doing good but because of mistake with HR representative, they did not communicate well with all the information in the beginning. So, AC21 is technically already being sent to USCIS with letter from my new employer because first I was being told that my new company will not send any document from their side. But now new company is again asking me that they need to send AC21 prepared by their attorney and I need to sign G-28 as well. and I am not able to convince HR that the first letter being prepare is also for AC21. My biggest worry is if first AC21 letter and second AC21 letter does not match then I will be in BIG trouble. Now its matter of my entire career.
Hope to hear more from the gurus.

There are scenarios where people were moving in to drastically different (atleast on paper) positions, like from programmer Analyst to DBA.

Well, you need to work with the employer for some time. It is not that you see the approval mail, and send your resignation to your HR. You need to, conservatively, stay with your employer for around 6 months to a year before moving on. Then again, if you plan your change of job before you get your GC, you are getting your GC on a fraudulent basis.

I'm working with the same employer for the past 4 1/2 years. My six year H1 is getting expiring on 02/2009 and having B.Tech & MS from Indian University with 13 years of toal experience (8 years in India and 5 years in US). Can my employer apply PERM Labor in EB2 even if my EB3 I-140 still pending from NSC by retaining the same PD of EB3?. Is there any possibility of applying directly one more I-140 in EB2 without applying PERM and not affecting my EB3 I-140 process?. One more thing am I eligible for premium I-140 for EB2. Bottom line can I apply EB2 by retaining the same PD of EB3 by taking advantage of I-140 Premium processing.
Please advice me.

Mine was the similar case... last year when my PD was current... i got I-485 denied for the same reason... filed MTR and case got re-opened.... Unfortunately somtime it takes 6-7 months to re-open...
my MTR was approved long ago... but case status still shows denied on USCIS case status.... due to some bug in USCIS software... thats the response i got from them...
They say they gonna correct it....

I am currently working for the State. Very stable job, decent income, 40h, very low stress environment. Drawback is lack of promotion, no bonuses, no salary increase. Technology wise the job is not bad - although you can't compare the exposure to a consultancy job. I have started my own consultancy Limited Liability Company and I am starting to get few extra projects here and there. It is hard to find clients though.
My only relucantancy to quitemy job - provide I get the GC in the next six months - is the medical care and interruption between assignments.
As a consultant, which are the best companies out there for people in the 30's ? Also, how about trips ? Do you guys don't bother to travel a lot ? That's a strong reason I am reluctant to consider consultancy, however, thanks to this damn retrogression I may well have to work way harder to make more money !

Applied for my GC the 4th time.....Finally realized that the American dream can only become true when you are an entrepreneur.....Got into consuting...almost a entrepreneur...got a huge boost in my salary and there is no fear of losing the job, since it is my friend's company. Yes, he takes a portion of the billing rate...but hey he also needs to make money in business....I have no regrets
The catch is...you need to work with somebody you can trust...there are a lot of DESI outfits who can mess up your GC , job and your salary....So be careful....yes the market is good and the rates too are good.

No, I didn't receive any RFE, I submitted new employer letter along with cover letter when I changed my job using AC-21. I got straight approval after 11 months of sending letter without RFE.

This came up while going over employment history in the N-400 application. To my surprise, my AC-21 letter was in the USCIS file with the IO. There were couple of questions regarding Job Title, Desc, Salary and Duration. I was the AC-21 employer for almost 5 years - 1 year before I-485 approval and 4 years after that.

Sure..as soon as all (or at least majority) of those people wake up and ask for some relief, IV-core might start the public action item to ask for I485 filing without current PD.
Mostly, what will happen is folks will keep coming back complaining how there is no filing 485 filing relief not realizing their inaction is the reason there is no relief.
Great work by IV on getting this EAD/AP fix. Such successes keep us motivated and hopeful
