USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. As such, the Service continues to accept advanced degree petitions as experience dictates that not all such petitions are approvable. Hi,
My wife had a EAD and it is expiring in October 08 and my wife's H4 is expiring in August 08. I got a mail from my employer to renew my H1 and my wife's H4 status as both are expiring in August.
I am planning to extend my wife's EAD Next week as she had plans to work.
My question is, is it advisable to extend my wife H4 also? Is there any problem because both applications (H4 and EAD) will processed by uscis at the same almost time.
Please advice.

With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

I and my wife want to start business ( daycare/pre school) and want to know below details.We both have Green card.
1) Do I need to open LLC or INC for this ?
2) I have home loan so will I get business loan for new property.
3) We already Identify property in our area.

Yes, your current & past paystubs(Primary H1B holder) are needed to grant H4 Visa for spouse. H4 is a dependent visa and is granted based on the primary H1B visa holder's status. In case of transfer from H1B to H4, his paystubs are also needed to proove that he was in legal status during this time.

Hi,
Company A filed I-485 (PD Aug 28, 2006). Another Company B filed for I-140 with a pre-approved labor dated Nov 23,2005. If the I-140 gets approved from Company B, can I use that to port my priority date to Nov 23, 2005? If I move to Company B after porting the PD, do I have to stay with Company B and if so how long?
(I am planning to stay with Company A for 6 months and then move to Company B using AC21. )

I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .

I am listening to the call. Debra Rogers from USCIS stated:
1. Approx 300 k EB cases received in Jul AUG.
2. All Family based cases entered and receipts issued.
3. All EB based AOS applications will be entered and receipts issued by End of this month.
