Hello All,
I am new to this forum and this is my first post. I am not sure if I can even bring this topic up about PERM in this forum. So, if this is irrelavant, please let me know.
My employer will be submitting a PERM application for my L.C. in a day or two. All the requirements for the job are complete. My question is, on the applciation there is question (Q:12) which states about "business necessity" and my employe will be checking "NO" as the answer. I am not sure what impication this could have on my application. The job requirement is B.S. degree with 5 yrs experience. I have a M.S. degree with 5 Yrs experience.
Please let me know if we are going in the right direction.

i got ead(secondary person) yestesday.and also i applied H1 B which got approved 1 week back and i want to take SSN. so my question is with
what(H1B or EAD) i should apply for SSN). Do i need to apply SSN with EAD or H1 B? which one will be better ? please let me know.

I am a July' 07 I-485 filer and have received my EAD and AP.
I am currently on H1 and not using my EAD yet.
In my situation can I accept any contract work on 1099? This will be beside my full time work.
Do I have to switch to EAD from H1 to accept 1099 for contract work?

Yes he is in 'Adjustee Status' also a person can start working as soon as new employer files H1 petition on his/her behalf. So if the petition was filed on time and took 40 days to be approved your friend was in H1 status since the day the petition was received by USCIS

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.
I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?
Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?
I will appreciate your help.

Hello,
We have our 485 interview's next week @ the Baltimore Field Office. My PD is current for EB-2. My case is pretty straightforward so hopefully should not be a issue.
Would appreciate any comments from folks in MD who have been interviewed @ the Fallon Federal Building in downtown.
Particularly - can they approve our cases right there & then.? Will they stamp our passports for approval since PD is current for January 2011.? Can there be any issued with visa number not available, etc. ?
Any advice is appreciated.

11,100 H-1B visas remain of the 65,000 quota with 1500 more claimed over the last week. That's a moderate increase from the roughly 1200 used weekly over the last month. I'm pushing my exhaustion target up a week. The master's cap of 20,000 will be reached sometime this week, almost exactly the date I predicted several months ago. The 400 visas claimed weekly in this category will presumably shift to the general H-1B cap and that could accelerate depletion of those visas. That being the case, we could very well see the cap reached next month.

In my opinion I think we should get the news guys into this and get the information out there about the irresponsibility with which they have mismanaged the whole process. Such kind of problems usually grab headlines when it happens with US citizens.
I think we need to be heard. Imagine, insurance companies violating makes news, social security makes news, airport security regulations and mismanagement makes news _ WHY CANT THIS? THIS IS SO CRUEL. HOW MANY HOURS, MONEY, EFFORT HAS GONE DOWN THE DRAIN? CAN WE NOT GET SOME NEWS CHANNEL TO COVER THIS? SOMEONE TO SPEAK TO A JOURNALIST ABOUT HOW AWFUL IT HAS BEEN????
THIS HAS ALL THE ELEMENTS OF PAIN, AGONY, AND DECEIT. Please comment. Only when we do this, will we get the EB numbers to get increased. Only then , the lawmakers will get up and smell the coffee. LEGAL IMMIGRANTS AND WHAT DO WE GET AFTER OBEYING THE LAW? MISMANAGEMENT THROWN AT OUR FACE.

I just got off infopass appt. after talking to someone in USCIS serv center.
was told that the case is in the examination section. He did not give me any details as he said thats all what he sees on the screen.
any one tell me what that means and how long could it before they will adjudicate?

USCIS has announced that beginning October 1, 2010, domestic offices and U.S. territories, including the U.S. Virgin Islands and Guam, will no longer be accepting cash payments. Other payment options will include money orders, credit cards, and checks (including personal checks).

I filed the i-140 last October, and didn't hear anything until May 2007 when i received an intent to deny. After speaking to the attorney he put the wrong name on the application! He fixed that then forgot to send the check!
So we refiled a new I-140 again PP, and referenced the labor certificate in the old case that we appealed.
They looked at the new case, and put in a request to get the original labor cert from the old case, which took about two months.
I received approval yesterday.

My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.
