i do not understand how overstaying and transit visas are related.
the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!
even the US now requires this so the UK only did a copycat deal, but the issue here (besides money grubbing behavior) is the way people are treated. sorry lost in space...but you do not seem to understand. if you do not step on UK soil you cannot overstay. the purported reason for this "walking visa" is security. and we all know that "security" can these days be a euphemism for treating people pretty badly. personally if i had the choice when transiting i would not go through london...ever. if nothing else the taxes are astronomical and they make the tickets more expensive most times and walking from one gate to another involves serious hassles with new security checks and long lines. and i do hope that enough people vote with their feet so the UK govt pays attention. london is too wonderful a city to lose out like this....

Your response would depend on how badly you want this job.
Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

The key here is revocation vs. substitution. Per discussions with immi attorneys, AC21 portability is not explicit on what needs to be done if I140 is substituted by previous employer and NOT REVOKED, and the applicant is eligible for changing jobs (same desc and 180 days pending). The fact is that this loophole leads to illogical scenario--2 applicants taking benefit from same I140.
Question to you and other forum members: Is there a thread on this specific topic?

since a lot of people are debating on this issue and a lot are researching on it ( i know atleast 2 people are actively researching on this topic :D). Does any one know how can i find the status of my PD porting. My lawyer sent the request in June after 3-4 days a say LUD on my 485/140/EAD/AP. I filed my 485 on July 2nd 2007 with a ND of August 17 2007. My EB3 PD is oct 2003 and my EB2 PD is July 2006. Do you guys think the LUD was because USCIS has Ported/interfiled my PD, Is there a chance for the Green in next 2 months?
I think the people who are trying to file the Lawsuit must be the most knowledegable people about this issue, Can you guys provide some +ve response for a change.:D

I got an RFE asking for my "Education Board Certificate". I was told that it is 10th or 12th pass certificate. Its been a long long time since i passed. Does anyone know or has any experience on getting a duplicate from CBSE Delhi?

Could it be that the AILA is talking about the 4th category and AILF's Legal Action Center is seeking plaintiffs - mainly 4th category that got their applications rejected?

Thanks Appas.. I sent an email to ombudsman on tueday and got a response on wednesday with the message. I also attached DS701 form, copy of I140 approved notice, I485 receipt notice.

Why has AILA not yet filed a class action lawsuit? Why have no lawyers filed a lawsuit on behalf of the entire community?
Let us ask thiis question to all our lawyers and ask them to communicate to AILA? Speeding up namechecks will truly help immigrants and will annony employers who want to keep us waiting as long as possible.
This is an open question to all lawyers reading this post. If you can file such a lawsuit, it will be a big help to this community and you will prove to us that you truely care for our cause.

My status was changed from Initial Review to PDA.The status changed on Aug 7th. There is no CPO or Decision status in between.
I see the following message
On August 6, 2010, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
I got my 485 Approval notice copy on Dec 13th and haven't received any welcome letter or my actual card.
Is any one in the same state. How long does it take for the actual card to come.
I need to renew my DL by end of this month. Can I renew it using my 485 Approval notice copy?

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.
If anyone come across in this situation then please reply to my question.
