    I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences

    01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that

    02. Submit current dated EVL for your new employer. No issue. we can answer that

    For my wife also asking for 2 evidences:

    01. About the same medical issue.
    02. Provide her non-immigrant status between Feb 2003 to Jan 2004.

    I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.


    I personally know a friend of mine who did the same mistake. He was not aware that he will also have to file for his wife when he did an h1 ext few years back. Lawyer was also not aware that he was married at that time. His 485 is still pending in EB-3, so no idea what would be the outcome.

    If someone is smarter to get his way ahead of me, it is good for him/her. I cannot blame my status on someone else's intelligence/ smartness. If I do not know how to play the game, it is my problem (it actually is, hence I am stuck). But that is OK. I am happy the way I am.

    I like what you say. That attitude helps long-term for leadership! Selfishness and mean attitude is only shortsightedness.

    Hi,
    I am happy to share the news that I received CPO hard copy on exactly Diwali Day. Lord Ramachandra Ki Jai.

    Here are the details of my case and what did I do to get this CPO mail. It may help others to follow up with USCIS.

    1. Applied EB-3 India in July 16th 2004 .
    2. Waited for about until 2006 July, but no signs of EB-3 labor approval.
    3. Applied EB-2 labor under PERM Sep 2006 and got approval in 7 days. this was amazing………..
    4. Applied I-140 for EB-2 labor in Oct 2006 and received approval after 6 months, still my EB-3 labor not approved.
    4. Applied I-485 on July 2nd 2007 along with my wife with EB-2 PD Sep 20th 2006.
    5. Received the receipt notice with the notice date of Aug 30th 2007 and receipt date of July 2nd 2007.
    6. Received the Finger print notice on Oct 15th 2007 and gave finger prints on Nov 10th 2007.
    6. Received the EB-3 labor approval in Dec 2007 and applied for i-140 for eb-3 and received i-140 approval in June 2008.
    7. Now I have 2 i-140 approvals one EB-3 with pd of July 16th 2004 and other eb-2 i-140 with Sep 20th 2006.
    8. Changed to better attorney who can better handle the i-485 in terms of the PD transfer and follow up with USCIS.
    9. Attorney sent Priority Date porting request to Texas service center in June 2008 along with new g-28 forms.
    10. Called at least 4 times in 2008, but got the response that my processing dates are not current yet means. Not reached the July 2nd 2007 or Aug 28th 2007 which is my i-485 notice date.
    11.In June 2009 Called USCIS POJ method and got some nice officer in Texas service center who opened the SR to open my case as my case is out of processing time.
    12. Got soft LUDs in June 20th 2009 and called usics cust service and came to know case is assigned to an officer.
    13. In July 20th 2009, got email update saying the case is transferred to NBC for further processing.
    14. Next day again got email, case is transferred to NBC and I will receive the interview notice.
    15. Got interview notice to go to local office on Aug 5th 2009.
    16. Online status changed to case transferred to USCIS office........
    17. Went for the interview on Aug 5th 2009 to local USCIS office along with my wife, office was very nice. Officer asked general questions which are on i-485 (like have u been arrested, have you been involved in terrorist activities etc.) form and questions about my wife's name and marriage date etc.. Officer did not ask even for employer verification letter also, I myself handed over that letter to her. She did not even saw that letter.
    18. Dates were not current on Aug 5th 2009, and officer told, she will take a decision after dates are current.
    19. Waited for Sep visa bulletin and dates became current, as my case is at local USCIS office, all attorneys who are the members of AILA will have direct contact to local USCIS office supervisor ph no and email id. These details will not be known to applicants. My attorney sent an hard copy request on Sep 5th 2009 to local USCIS office to adjudicate my case as my PD is current.
    20. Waited until Sep 15th no update was received from Local USCIS office or no update on i-485 LUDs online.
    21. Took info pass on Sep 16th 2009 and went to local USCIS office and got nice Info pass immigration office, very co-operative officer. He told me that my case is now back to central storage location and waiting for the visa no. I told him my PD is current, officer himself gave me an yellow form (please request for this form, otherwise they don’t give it normally) to fill up to send to other department supervisor in local USCIS office. Filled up and gave the form along with my i-485 receipt notices and i-140 notices. Officer asked me to wait 3 to 4 weeks to contact again. No luck until Sep 30th 2009.
    22. On Sep 26th 2009, attorney sent an e-mail to local USCIS office and got the standard response on Oct 1st 2009saying to wait for 3 months etc..Again attorney received an e-mail on Oct 2nd 2009 that my case will be adjudicated soon.
    23.On oct 4th 2009 took info pass again and went to local uscis office, again got nice infopass immigration officer and explained that they will request visa no only once (recently Murthy law firm posted that way USCIS and DOS dept interact) and I need to wait until visa no assigned by DOS. Gave again yellow form to sent to local USCIS supervisor to look into my case.
    24.Called 1-800 number and asked if there was any update on my case, got very very nice supervisor from customer service center, and he told me that my case is now assigned to an officer on Oct 6th and I should see result in 2 or 3 days.
    25Atttorney sent an e-mail again to local USCIS office explaining my PD porting details just to inform officer again.
    26.Got CPO email Friday oct 16th and received courtesy notice of approval i-485 on Diwali day on Oct 17th 2009.

    If the case is at local USCIS and your PD is current, please take info pass every 2 or 3 weeks, and request for yellow form and fill it up and give to info pass officer. This will help to move the case faster if the case is at local USCIS office.

    Overall, please call repeatedly to USCIS cust service to get some good officers and you will really here somany good things from them. What I understood from my exp, that the customer service officers now far far better and good than 6 months back..Really thankful to USCIS for providing good customer service.

    I hope this post helps most of the people whose dates are current....

    LOU DOBBS: Well, I can recall what was said if it�s at all helpful. I said that according to a study�I didn�t use the attribution, but according to a study that Jorge Borjas at Harvard University had completed, that the cost of excess immigration into this country amounts to $200 billion a year in wages, that the cost of incarceration, medical care, social services approximates $50 billion in this country per year. And the reality is that about a third of the crimes that are of those in state prisons�federal prisons, excuse me, federal prisons, are�I�m sorry.

    AMY GOODMAN: Are�?

    LOU DOBBS: Are those who are in this country illegally.

    AMY GOODMAN: Let�s play it.

    LOU DOBBS: Sure.

    AMY GOODMAN: And then let�s talk about it.


    Let�s say the number is eleven million, although some studies put the number as high as twenty million illegal aliens in this country. That not only amounts to a shift of six to ten congressional seats among the states based on the population of illegal immigration. The fact is, those illegal aliens are costing our economy $200 billion in depressed wages for working Americans. It is costing $50 billion a year in social and medical costs. And it�s costing us, no one knows precisely how much, to incarcerate what is about a third of our prison population who are illegal aliens.

    AMY GOODMAN: So, Lou, you said a third of the prison population are illegal aliens.

    LOU DOBBS: Right.

    AMY GOODMAN: The fact is, it�s something like 6% of prisoners in this country are non-citizens, not even illegal, just non-citizens.

    LOU DOBBS: Right.

    AMY GOODMAN: And then a percentage of that would not be documented.

    LOU DOBBS: Well, it�s actually�I think it�s 26% in federal prison.

    AMY GOODMAN: But you said of all prisoners.

    LOU DOBBS: I said about�yes, but I�and I misspoke, without question. I was referring to federal prisoners.

    AMY GOODMAN: But you didn�t say that, and so it leaves people with the impression�

    LOU DOBBS: Well, I didn�t, but then I just explained it to you.

    AMY GOODMAN: But you have a very large audience on CNN.

    LOU DOBBS: I have a very large audience and a very bright audience.

    AMY GOODMAN: And you told them that a third of the population of this country are illegal immigrants. 6% , which is under the population of immigrants�

    LOU DOBBS: 6% , right.

    AMY GOODMAN: �in this country, of prisoners�

    LOU DOBBS: In state prisons.

    AMY GOODMAN: �are immigrants.

    LOU DOBBS: In state prisons. In state prisons.

    AMY GOODMAN: No, 6% overall are immigrants. You said 30% are illegal.

    LOU DOBBS: Well, I think we�ve established�we could sit here and say this all day, Amy. The fact is, the number is 26% in federal prisons. That�s what I was referring to.     LOU DOBBS: Do you know how many reports we�ve done on illegal immigration in this country?

    AMY GOODMAN: Yes, many.

    LOU DOBBS: I mean, my god.

    JUAN GONZALEZ: Yeah, but I�d like to get into this issue�I mean, aside from the fact that the GAO report�

    LOU DOBBS: Excuse me, just one second.

    JUAN GONZALEZ: Sure.

    LOU DOBBS: I mean, what if I were to sit here and just hound you because you said I was anti-immigrant, when I am, point of fact, I�m anti-illegal immigrant, and it�s absolutely a matter of fact. We could quarrel over the terminology, if you want. But why should people of good faith and intelligence sit there and be so absurd about it?

    JUAN GONZALEZ: No, we agree on that. But this is precisely the lumping of illegal or undocumented immigrants and legal immigrants in one category that�s a problem�

    LOU DOBBS: Right.

    JUAN GONZALEZ: �because, for instance�

    LOU DOBBS: Right, I agree with you.

    JUAN GONZALEZ: �the total percentage of the non-citizen population of the United States right now is about thirty-five million, 12% of the population.

    LOU DOBBS: Do you know this?

    JUAN GONZALEZ: Well, this is Census Bureau�

    LOU DOBBS: I was just�I was just�

    JUAN GONZALEZ: Wait, wait, Lou. Let me finish. Let me finish, Lou.

    LOU DOBBS: I have to say, I was laughing about the NIE, because, as you heard Steve Hadley talk about�

    JUAN GONZALEZ: Lou, let me finish.

    LOU DOBBS: �high confidence levels in those estimates,�

    JUAN GONZALEZ: Right, but let me�

    LOU DOBBS: What do you suppose the confidence level is of the United States government in the number of people in this country illegally, the number of people�

    JUAN GONZALEZ: We�re assuming now�the legal population is pretty well documented, right? But the�

    LOU DOBBS: Documented, undocumented.

    JUAN GONZALEZ: The legal immigrant population is pretty well documented. It�s about twenty-three million. And then you add maybe another eleven to twelve million of the undocumented population, and you get thirty-five million. The point is�my point is this: if 12% of the non-citizen population of the United States�non-citizens comprise 12% of the population. They comprise 6% of the prison population. That suggests to me that crime rates are far lower among non-citizen immigrants�legal and illegal�than they are among the general population of the United States.

    LOU DOBBS: Can I ask you a question?

    JUAN GONZALEZ: You have raised the issue of crime�you�ve raised the issue of crime in relationship to immigrants.

    LOU DOBBS: Well, silly me, silly me. MS-13, all sorts of gangs. You know, the fact that Mexico is the largest source of methamphetamines, heroin, cocaine, marijuana entering the United States. Silly me for bringing up crack.

    AMY GOODMAN: But, Lou�

    LOU DOBBS: But may I ask you a question?

    AMY GOODMAN: I think you agree�

    LOU DOBBS: May I ask this question�

    AMY GOODMAN: I think you would agree�

    LOU DOBBS: May I ask this question�

    AMY GOODMAN: �that facts matter.

    LOU DOBBS: Of course, they do. Absolutely.

    AMY GOODMAN: And so�

    LOU DOBBS: I am an empericist to the bone.

    AMY GOODMAN: And so, if 6% of prisoners are immigrants�documented and undocumented�and you said 30% of prisoners, a third of the population of prisons in this country, are prisoners, it conveys a very different sense.

    LOU DOBBS: Different meaning.

    AMY GOODMAN: And as you�ve pointed out�

    LOU DOBBS: I agree.

    AMY GOODMAN: �you�ve done hundreds of shows on these issues.

    LOU DOBBS: More than that. More like thousands.

    AMY GOODMAN: And that reinforces the feeling that people have, who watch the show�

    LOU DOBBS: So, your point is?

    AMY GOODMAN: �either they believe you or�either they don�t believe you, or they believe you and are being fed wrong information.

    LOU DOBBS: Well, I don�t�you know, I think it�s important for all of us, because, as you say, I�m�we�re all interested in the facts. So let me ask both of you, please, a question that seeks a fact: Does the United States government and do state governments inquire of their prisoners as to whether they are legal or illegal, and can they under the law? Or are these estimates that we�re talking about?

    AMY GOODMAN: Well, if the government doesn�t know, how do you know?

    LOU DOBBS: No, that�s as straightforward question.

    AMY GOODMAN: How do you know?

    LOU DOBBS: Well, because in the federal prisons, they are permitted to make a decision as to whether or not they can ask if they�re citizens or non-citizens, but cannot ask if they�re legal or illegal. So it is, at best, a projection. When Juan says eleven million to twelve million illegal aliens, you and I both know that the Bear Stearns study suggests twenty million people. There is no one in this country today�that�s why I referred to the National Intelligence�

    AMY GOODMAN: And the Bear Stearns study has been critiqued over and over again�

    LOU DOBBS: By whom?

    AMY GOODMAN: �by the top economists.

    LOU DOBBS: Oh, come on!

    AMY GOODMAN: Bear Stearns study, saying it is wildly exaggerated, that their�

    LOU DOBBS: The National Intelligence Estimate is closer probably on Iran today than it is on the makeup of the US population today. I mean, if you want to talk about this nonsense, I mean, that�s what it is.

    AMY GOODMAN: Let�s go to break, and we�ll come back.

    I have been a reader on this site for years and have contributed to many of the fund raising campaigns. I agree with many of the comments on this thread. Brothers and sisters we need to team up and clamour for fair treatment; let us all contribute with dollars and sweat. I assume most of us on this site can afford to contribute a lot more than we have in the past and the potential rewards (fair opportunity to Immigration) are immense.

    I have personally been in the US for ten years and believe I have contributed to the society a lot - while being a law abiding tax payer (I wish I could use the word citizen). And my story is not any different from any of yours. Why then we haven't gotten what we deserve at this point, afterall we have earned it by our sweat. The reason is we haven't realized our strength: in numbers, in dollars and in our contribution to the American society. No one is going to listen until we make our plight known to the public at large and to the law makers.

    Some thoughts on how to go about doing it. We need a detailed plan with names of volunteers who can contribute their time. The plan should also include a list of key law-makers we are going to contact and how. All of this will cost money - so the first thing to do is support the fund-raising efforts. I also think we need to increase the fund-raising target by a lot; because the stakes are so high.

    I apologize if I have wasted anyone's time with a long post. And I thank all of you for caring for one another and by sharing so much info with all the silent readers of this site. I have learned more about immigration from this site than my employer or immigration attroneys could ever share with me.

    I will now put my money where my mouth is by making a contribution to Immigration Voice.

    If EB2 row perm hits 10000 apps thats it pd wont move a bit. That will happen as soon as hiring starts again. This will happen any time, if this not happen until sep 2010, then EB2 has a chance. There are about 15000 (approx) EB2 Row apps siiting ducks in Perm centers, if ROW PErm eb2 approvals start flowing then we are just stuck. It all depends on EB2 Row Now. That is the one we need to watch closely.

    When you buy a home you sign a contract saying you will pay the loan amount at the end of the loan term with interest. There was a commitment made. And you are saying people who walk away without fulfilling their obligation are smart? Fool!


    And who do you think is footing the bill for bailing out those banks? its you and me! You are not only not honest and ethical, you must be really dumb if you think you are not going to be paying for the mistakes of people like punjabi when they "walk away" from their homes!

    I was asking for Ideas.. it is not just Kumar or some more people giving an idea that one should leave the house if the value of the house has gone down and now you have to move because of ur job and it is hard selling ur house where u may have to bear a loss ..
    I already had conversation with american people ( not any desi's) in my office and they also had the same opinion as to leave a house if u have to leave because of job..
    U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..
    about me making a bad decision about buying a house.. well not 2 years ago..
    i can sell the house for a loss of may be 20,000.. but why should i pay that money from my pocket.. i can keep that in my savings account and use it in my bad time..

    I always travel by Asia route. China, Japan, Thailand, Singapore or Korea. For people on the pacific route this is the best option. The customer service is pretty good and they do not harass you for every petty things.

    Fying from UK and France in particular feels like you are doing a favor to them. In this age of consumerism just stay away from British, Virgin, Air France and others and they will learn the lesson quickly. Iam very surprised why people take those routes. Just avoid them at all costs!

    But I can not help but notice the timing of priority dates becoming current and also these rumours.

    The priority dates became current right before the immigration bill was to be brought up for the second time in the senate. Now as the bill has been shot down, next day these rumours begin surfacing. Guess no need to keep us distracted anymore, so no need to go through the pain of getting bombarded with applications.

    I feel, both are extraordinarily extreme measures. Make priority dates jump 5 years in one month and then retrogress them in the middle of the month.

    Congrats!! good to know. If we can see the trend, I will be very happy man atleast got some attension for forgotten July 2nd souls... :)

    Good news guys, my checks have been encashed this morning, looks like they are processing july 2nd cases now, probably because of all the pressure from congressmen and all the complaints that have been going out to uscis-complaints.

    Finally some relief, the receipt #'s are printed at back of the check and its starts with SRC so i guess it has been transferred to either CA or TX.

    Hang in there guys iam sure all july 2nd filers will surely see their applications processed by early next week.

    EB2 I/C 6K (5800 exact, regular supply)

    New filing 2K (ppl who missed 07/2007 w/ PD before 07/2007, dependent)

    EB2I/C demand before 07/31/2007

    DOS, for having some buffer to counter (denial, RFEs, assuming little as most pre-adjudicated) will move PD for EB2/I

    Remember, CIS can take in new applicants in August 2011 but don't have to approve it.

    Can we try and consolidate the predictions by Teddy, Rodnyb, GCwait2007 and others who did some major number crunching (not armchair predictors like me).

    Teddy, based on what we know now especially the past few days, can you give your average, best, and worst case estimate for September 2011. Same for rodnyb and GCwait2007. Thanks!

    Also importantly, if you could comment on the PD for EB3-I/C and EB-2 I/C in October 2011 once this year is over. Will we see it retrogress or current and what's your average case for the dates then.
