    I am sorry, what do you mean by FedEx/UPS/DHL will NOT deliver? Do you mean to say that they will not deliver on Sat/Sun?

    How about mailing Friday with over-night? Will that reach on Monday as well?

    UPS/FEDEX/DHL by law are not permitted to deliver to PO Boxes.You can search the forums for more information about this.

    Great news. Kudos to Vivek ,Srini and MBartosik, whose unrelenting and steeled resolve on this issue is tremendous.

    The Governor has promised to sign this as soon as it arrives at her desk. To her credit she has applied pressure on the legislature behind the scenes too. I got a letter from her office yesterday mentioning that she is eagerly awaiting a bill on her desk.

    I was pleasantly surprised that the final bill is less restrictive, and more close to the previous guidelines for LEGAL immigrants. I must admit I did not expect much more than provisions in other states where time limited temporary permits would be issued. I guess strong advocacy does work!
    Even Lou Dobbs show was docile about this in their reporting tonight. They mentioned the ACLU lawsuit, but stated that it was requesting clarification on the issue of asylum seekers could get licences.

    Well done guys.

    There is NO good lawyer. They are all the same & you intend to learn the hard way. Read my post again. My current lawyer is all paid by my comapny & still turned out like earlier lawyer I hired.

    Looks like there is some changes on the lawsuit - instead of signing up as plaintiffs, the lawsuit may consider every eligible July applicant as a plaintiff so we may not need to sign up - I have requested pappu to find out more about this as he is in contact with aila.

    Looking at the approvals from TSC and nothing from NSC, it looks like PD - RD - ND does not matter. All that matters is your luck. Some lucky souls got their GC processed while other with 2003 and 2004 PD were still waiting to see the light from NSC.

    Something tells me that NSC might be working on 485 cases like TSC with an exception of sending or updating the approval notices as and when they are completed.

    Maybe they will send all the approval notices this weekend for the cases being worked on till now.

    After seeing the Immigrationwatch on the number of approvals and cases touched at NSC(not sure how reliable this is)but , this might be the case.

    Also, if you see the history of NSC on approval notices sent , this might make sense. Example did anyone observed this trend in EAD approvals from NSC? My Approval notice for EAD says that the Case is approved on 12/11/07, however the Card expiration date was valid from 12/05/2007 to 12/04/2008. A gap of 8 days between date sent and actual approval

    Even if you are going to stick with a Desi company which is going to lose some amount of revenue due to this type of attrition, I don't think it will be a problem. You will stick with a company only if you get the right pay as described in your labor and if the company has solid financials to pay you that money and if you can prove that by using W2s and paystubs, there won't be any problem.

    In case, if you moved out of that company using AC21, the financials of that company will not matter any more. But you must be in a job which pays equal to more than the amount specified in your labor (one with the company for which your 140 was approved). But it matters till the day you terminate your association with the company. Till that day, you must be paid as per the labor.

    As reported in the New York Times, unauthorized immigrants got a big break from the U. S. Supreme Court this week. The Court ruled unanimously that prosecutors cannot use federal identity-theft laws against illegal immigrants who use Social Security numbers belonging to U.S. citizens in order to get jobs. Here are excerpts from the Times article:

    The question in the case was whether workers who use fake identification numbers to commit some other crimes must know they belong to a real person to be subject to a two-year sentence extension for “aggravated identity theft.”

    The answer, the Supreme Court said, is yes.

    Prosecutors had used the threat of that punishment to persuade illegal workers to plead guilty to lesser charges of document fraud.

    “The court’s ruling preserves basic ideals of fairness for some of our society’s most vulnerable workers,” said Chuck Roth, litigation director at the National Immigrant Justice Center in Chicago. “An immigrant who uses a false Social Security number to get a job doesn’t intend to harm anyone, and it makes no sense to spend our tax dollars to imprison them for two years.”

    Justice Samuel A. Alito Jr. said in a concurring opinion that a central flaw in the interpretation of the law urged by the government was that it made criminal liability turn on chance. Consider, Justice Alito said, a defendant who chooses a Social Security number at random.

    “If it turns out that the number belongs to a real person,” Justice Alito wrote, “two years will be added to the defendant’s sentence, but if the defendant is lucky and the number does not belong to another person, the statute is not violated.”

    Justice Stephen G. Breyer wrote that the case should be decided by applying “ordinary English grammar” to the text of the law, which punishes an offender who “knowingly transfers, possesses or uses, without lawful authority, a means of identification of another person.”

    The government had argued that the “knowingly” requirement applied only to the verbs in question. Justice Breyer rejected that interpretation, saying that “it seems natural to read the statute’s word ‘knowingly’ as applying to all the subsequently listed elements of the crime.”

    He gave examples from everyday life to support this view. “If we say that someone knowingly ate a sandwich with cheese,” Justice Breyer wrote, “we normally assume that the person knew both that he was eating a sandwich and that it contained cheese.”

    About 8 million illegal immigrants are working in the United States, the Pew Hispanic Center in Washington estimates.

    Stephen H. Legomsky, a professor of immigration law at Washington University School of Law in St. Louis, said Monday’s decision would have a major impact on the strategy of Immigration and Customs Enforcement, making it more difficult for the agency to press criminal charges against immigrants with no other offenses but working illegally.

    “In the ordinary immigration case, this will no longer be a weapon,” Professor Legomsky said.

    The Obama administration has said that it will shift the focus of immigration enforcement to employers who intentionally hire unauthorized immigrants in order to pay lower wages or otherwise lower costs. But last week the administration said agents would continue to detain illegal immigrants found in raids.

    i UDERSTAND YOUR PAIN. i HAD TO GO THROUGH THAT LAST YEAR WHEN I APPLIED FOR MY EAD. I MADE MANY CALLS AND ON ONE LUCKY DAY I AM ABLE TO CATCH A GOOD IO WHO HELPED TO GET MY APPLICATION FROM SOME DUST ROOM ( THEY CALL IT STORAGE ROOM). KEEP CALLING USING POJ METHOD.

    I am waiting on my spouse's EAD/AP approval. Applied on 8th July. My EAD/AP got approved last month (applied for myself and spouse on same day).

    I agree with you!

    based on whatever you have described, I would go for the new offer (salary+work is better, and gives you the EB2 option)

    Regarding your three concerns:

    1. If you are good, then people in new company will also recognize your work. If you leave on good terms, now you'll have double the number of people who like and appreciate your work and can come in useful if you need them in the future (old company as well as new one)

    2. family does get uprooted with a move across cities, but they'll settle down. Esp. if you move to an area where there are more families with your background or from your country of origin. Kids adjust far more easily than parents (based on the experience of someone whose parents were constantly "transferred" all over India as part of govt. service of the father)

    3. San Dimas is not that far off from San Diego; and its not like you are moving to the middle of wyoming or siberia :)

    Insurance does not care about your H1 Status...so stay put in the co to avail the insurance benefits.

    Ensure that H1 status is maintained....thats a separate issue that you have to fight out with HR.

    In many cos after 3 months or 6 months of disability, it is automatic termination. That does not affect the Insurance converage, (you continue to get the pay on disability if that was in your insurance plan) but you are no longer considered in the job. For you it raises another layer of complication as termination will mean H1 willl not be extended (or may even be revoked in extreme case).

    So you have to ensure that your H1 is maintained. How many days are left on your H1?

    according to Greg, USCIS will accept only small amount of applications which came in July..how will they decide which application to accept ?

    If they accept 1 application that came in in July, it will cause a lots of lawsuits. So I don't think they will elect to do so. They probably will come out with a different idea. They are trying to minimize the likelihood of law suits.

    What?? No - my visiting IV often doesn't translate into faith for IV. I visit IV to catch up on any news, to learn about unique situations members post. I visit bunch of other immigration forums.

    I never said core members are my employees...LOL where did you interpret that from?

    Instead of addressing concerns I have raised, you are trying to divert attention to my attitude?


    Update: Now if we are done with questioning my attitude, how about addressing the real point about bringing in more transparency into what IV does


    I once was lost and now am found, was blind but now I see.
