But my new employer is kind of trying to force and my contact in HR doesn't seems to have much idea. Everytime I meet with her, she tell different thing. And now the last thing I heard is that this is compulsory that my new company need to file another AC21 using their Attorney with new G-28.
My new job is completely in same category as my previous job. What could be the possible issues in future?
Gurus, please suggest. I am really stressed after invoking AC21.

What is the best way to mail 485 so that it can reach on July 2nd - Monday. As July 1st is Sunday i beleive no mail system will deliver the package on that day.
Given that, what is advisable to do? How about sending the package with over-night mail on Friday, so that it can reach there on Monday as Sat, Sun USCIS is closed and will not accept applications.

It is not surprising, even my HR had same problems, we had the attorney talk to them and explain that they need to give to candidate, company a****les believes attorney more than me.

Its easy to find out the Status of 140 if your pervious Employer Cancelled your I140
On reagular USCIS Case check website check the status with the Reciept #. if they cancel status will change to cancelled otherwise it says approved doc sent.

First, we should thank IV core member's hard work. Without their hard work, it is hard to say the Senate's Bill can be get approved. Now, no one knows what will happen in the future. But the core members are still working towards our objectives. The only thing we can do it to be patient and enjoy your life.

H6: is experience in the job offered required for the job? No

Please help. My company is planning layoffs in January and my team is likely to be targetd. I am currently on h1b with 6 years expiring in October 2009.
my 140 is approved and i have approval copy. what are my options? Can my H1b be filed for extension even though i am outside the 6 month window for h1b renewal? I know i have to refile the perm. since it is a 2008 filing i am not so worried about gc - but about status and h1b. Hwo do i tackle this please advise.thank you

I was surprised of how nice they were over the phone when I was trying to get the receipt number. Another way to check the receipt number is to log into your bank website and look at the check USCIS cashed (if you can). They usually write the receipt number on the check. However, my experience while I was at the center was horrible. I was treated like garbage at the Philadelphia center by the clerk. They weren't even busy or stressed. Just a pleasant slow day. I'm filing a complaint (if that even helps) per Adjudicator's Field Manual Section 2 that states how to treat customers. Yes, customers.

Hi All,
I wasn't sure where to post this question. Hopefully, it'll get some responses.
I am about to move to a new address at the end of Feb 09. I am a bit worried abt my pending 485 (filed in July 07). My PD is June 2005 EB3-ROW. I vaguely remember reading something on these forums a while back. My question is "can changing your address while 485 is pending cause an RFE for employment verification with the sponsor company? Reason I'm asking is that I am not working with the sponsor company anymore. I "had" to change jobs a year ago and thought it would be safer to keep quite about it to prevent confusion. Now, I'm about to change address and wonder if a change in address might get USCIS suspicious. I really don't want to deal with AC21 or RFEs to avoid problems with the process. I would really appreciate opinions/experiences on this.

You have to wait till 1st October as they issue SSN based on her New I-94 (attached to H1b approval notice) and 797 (H1 approval notice). As per her current I-94 (Status: H4), she is not authorized to work so they won’t issue SSN now. I went through the same exercise last year. They asked us to come again on 1st October.

when did you efile this? and which service center. I recently efiled our AP also with NSC and all I sent was this:
1) receipt confirmation page.
2) 2 photographs.
3) Copy of expired AP.
4) Copy of 485 receipt.
This is all I sent last time to TSC and they approved it fine. Its getting tougher and tougher to even move an inch with USCIS these days.

1. I-131 E-File Confirmation Receipt
2. Copy, USCIS Receipt for e-filed I-131
3. Evidence of Adjustment of Status filing
- Receipt Notice of I-485 application.
4. Copy, Previous Advanced Parole issued.
5. Copy, Official Photo Identity Document(s) with Photo, Name and Date of Birth
- Biographic Page of Passport.
- Employment Authorization Document (both sides)
- State Drivers License
6. Copy, Document Issued by USCIS Showing Present Status
- I-94
7. 2 copies of Passport Photograph
I have received an RFE on this. This is the what I got -
"Evidence of Eligibility: Submit a copy of your approval notice (Notice of Action, Form I-797) or receipt notice (Form I-797C) for Form I140, or Form I360 or Form I526. If you have filed the I485 as a derivative alien, submit spouse's or parent's I797C for his/her I-485 and the I-797 for his/her approved or pending I140, I360, or I526."
I am the primary applicant still on my H1B (7th year). My wife is working and on EAD. I guess I should have sent my 485 receipt, 140 approval, EAD etc. too and could have avoided this RFE. From the above statement, I infer that I should be sending the following documents now -
1. 'I797, Notice of Action - Approval Notice' for my approved I140
2. 'I797, Notice of Action - Receipt Notice' for my I-485 application.
Please let me know if this list of documents would suffice the RFE or if I need to send anything else like the following -

My Desi employer does not show me the real PO ( Purchase Order ) whereas at the same client other an American Vendor does show the real PO to their employees.
Is there any DOL link about it to share PO with Employees. ?

Let me guess, you are on 80-20 arrangement. That's why he doesn't want to show you the "real" PO. So he will give you 80% of his version of the PO rate. If you are FTE, he doesn't want you to see that he is making a profit of $60/hr from you. Otherwise you will ask for a raise.
I don't thin there is a regulation/law that requires your employer to show you the PO. However, the way consulting works, it would be ethical for the employer to give you the copy of the PO, more so when you are on % basis.
It is pretty easy to judge an employer in the beginning asking him if he will give you copy of the actual PO, even when in the pre-hire stage. If he agrees, make that part of the formal joining or acceptance letter.
Other consulting companies are learning fast from Desi cos. They are just a few steps behind desi cos for taking advantage of their immigrant employees.

I had a Infopass apt this morning and the IO told me that my name check was cleared. My PD is Jul 2005 (EB2 India). 140 approved 18 months ago. anyidea I get approved in August?
Paddy what is your receipt date. My PD is April 22nd , 2004 but my receipt date is July 27th, 2007 or so. I think they will pick up the cases according to receipt date.

Are you planning to relocate to canada soon? I ask because canadian PR requires that the person travels there before the stipulated date or else you have to start all over again.

GC finally came thru - foolish process ended on the fools day.
EB3 priority date is sept 01, India.
has taken 9 clients, 7 years, 6 H1Bs, 5 relocations, 3 GC filings, 2 layoffs, 1 labor substitution, 1 RFE, 1 EAD, 1 UK HSMP visa and 0 visits to India to get here.
sucks.
