If the wife is filed under my i485 but her i140 is also applied........can she go for extension of her H1B after 6 years with her pending i140 application?
Or, once she file 1485 with my application her i140 is deemed to be closed?

Normally fortune 500 big companies no longer hire people on H1B.You are lucky.Even green card holders and US citizen are jobless.Why? If citizenship and green card (immigration status) is so much important then why so many US citizens prefer/like to stay un-employed?USA is not the end of this world.With the current sinking economy, medical insurance,high deductibles, pathetic medical care, unemployment, third class educational facilities (school to universities), useless taxation etc. etc. If you are with Fortune 500 company you can easily move to Canada,UK,Europe,India,Saudia,Australia,UAE within Fortune 500 company itself. Everywhere you will be paid in USD$.The biggest dark side (financial drawback) is that green card holders,US citizens must pay US taxes forever until they die ("Tax Servant/Slave").

One thing that worries me is the there is a field for "Employer info" on AR-11. The fact that I switched employers and never filed an AC21 might raise questions since my current employer is different than the sponsoring one. I would assume you haven't gone through employer change yourself?

No I was with the same employer & only reason I changed address was because my current apartment lease was getting over & I wanted to move to a different apartment location. It is in same zip code just like a mile away from previous apartment.

U r right. Some folks may not be happy even if IV dramatically gets a GC for everybody today itself. I understand what u r saying.
Let us see how many are willing to contribute after filing 485. Even then people will say they are short of funds even $100 because they have filed 485 and spent everything on attorney. All these days they were cribbing that nothing have been achieved, now they will say that it is not because of IV. Some will say, now filing 485 is not enough for me, I have to get EAD and use AC21 portability so that I could earn more and then I will THINK to contribute. If they use AC21 then they will say, I want my spouse to work on EAD so that I will be financially sound to contribute to IV and it goes on and they will never contribute for ever.

My question is, can she transfer her H1-B from company A to company B without any employment history and or pay stubs from company A?It depends on how USCIS will treat your wife case..
She may/not get the transfer .
Under what cisrcumstances can my wife start working for company B?
Company B doesnot allow sub contracting and the only way going forward is H1-B transfer.
Only after Approval from Company A or Transfer to Company B
Adding to this company A is not cooperative and they know about an outstanding job offer from company B.

2) Please follow the general rule to file address change form (online).
3) When you have your case number call and write a letter indicating your situation

However, if you did by DIY then USCIS will send your receipt to your old address and USPS will either forward to you or return to USCIS. If you send your 485 receipt copy and Marriage Certificate you should be fine. Since she was applied as your dependant, you have to submit your 485 as well and marriage certificate to prove your relationship.

a similar kind of thing happened with our case. my husbands 485 status shows FP fee rejected when the checks are already cashed. and to our surprise we also got our FP notices.Our lawyer has already mailed USCIS the photocopy of the encashed check.
We have filled I-485 for Me my wife and my daughter, we have received Receipt for me and my wife but still waiting for my daughter.. now I can see from my bank account that her check has been cased but based on the receipt number from back of the check USCIS website says your case has rejected because of improper filling.
Please advice what should I do.. as I have still tomorrow to file again. If I decide to file what documents should I send.

My wife and I are not from the same country... So it makes it even more interesting to see each other when we go to each other's countries to see the parents...
We agreed on getting together regarless of the job situation by the april 2007. We are done waiting... :D

I think this is nothing but harassment. I think it is a 5 minute job taking 120 days just because they can do that. Again there is no accountability from USCIS. Nobody to ask an officer "why did you not pick up the file ?", or "why is this case pending for 80 days ?". Can I do that in my job ? I think , my company will throw me out even if I delay my job by 3 days(If I do it without any reason). But here is USCIS, can get away with anything and everything after extracting hundreds of dollars from our pockets. Yes, this is not sexual abuse and this is not racial abuse but this is an abuse to which the law has never given any name. And this is ramped in USCIS. Is it frustrating ? Absolutely. But we do not have any power to question them.

As everyone forgets - Visa, Status and Work Auth are 3 distinct things.
From what I understand currently you have
Visa - F1
Status - F1
Work Auth - OPT (with a few months left, correct?)
Another thing to keep in mind is that there is no such thing as H1 Transfer
every H1 is a new application, the only difference is whether you are counted in the cap or not
So if I understand your current applications are:
C1 - applied H1 with COS - pending
since H1 with COS is not approved your status is still F1
C2 - applied H1 w/o COS - approved but waiting for Employee 797
even though H1 is approved, since it was without COS, until you go out, get H1 stamped and come back on that H1, your status is still F1
C3 - offered you a job but you need to know what to do
you can have C3 file for a new H1. There is no such thing as "H1 Transfer". Since you have a approved H1 petition with C2, you are already counted in the cap. However since that was without COS, it has not changed your status. You are still on F1. The paystubs are provided with the so called "transfer" to document to USCIS that the prospective employee has maintained valid status with previous employer. Since you could not work with C2 yet, there is no need to show paystubs from C2 with C3's H1 petition. However, you have two options - either have C3 apply H1 with COS or without COS and provider C2's approval as a proof of being counted against the cap.
In such cases where you have 3 petitions pending (after C3 applies) it is highly likely that USCIS will approve C3's petition without COS, even if you apply for COS.
If you get C1's premium petition approved with COS, you can work for C1 without having to go out (like C2)
It is possible that since you already have a approved petition from C2 without COS, and pending premium petition from C1 with COS, the new petition from C3 may throw an RFE.

On April 1 2008,
Company C1 applied my H1B , Change of Status from F1 to H1B , Regular Quota
Company C2 applied my H1B, Consulate Processing, Regular Quota
Regarding C1 :
-I have been working with C1 since 2 years now and I have all the pay checks
-C1 received RFE in July 2008 and RFE replied within 2 weeks, Case Pending
-C1 applied for Premium processing on Jan 15 after long wait of pending
-3 LUDs on 3 consecutive days in the last week.
- Case still Pending
Regarding C2 :
- H1B applied on Consulate Processing, So basically it means I need to get it stamped to start my H1B
- I dont have any paychecks with C2
- C2 H1B approved in August , after RFE
- Twist : Employer received only Employer copy of H1B approval and not the copy that is given to the candidate.
- I have the scanned copy of Approval, that Employer received.
- In October 2nd week, C2 applied for "I824, APPLICATION FOR ACTION ON AN APPROVED APPLICATION OR PETITION" to get the candidate approval copy.
- I could not go for stamping because of that to start my H1B.
- So basically waiting on that

- offered me a job
- I have OPT to work with them.
- But I also want one of my H1B to be transferred... I dont know how to do that
- If the H1 transfer is not possible, I must ask them to wait till april to apply new one , which is not possible.
I am looking for a solution, on how to handle this
Q1) Will I be able to transfer my approved H1B from C2 to C3 ,

From what I understand currently you have
Visa - F1
Status - F1
Work Auth - OPT (with a few months left, correct?)
Another thing to keep in mind is that there is no such thing as H1 Transfer
every H1 is a new application, the only difference is whether you are counted in the cap or not
So if I understand your current applications are:
C1 - applied H1 with COS - pending
since H1 with COS is not approved your status is still F1
C2 - applied H1 w/o COS - approved but waiting for Employee 797
even though H1 is approved, since it was without COS, until you go out, get H1 stamped and come back on that H1, your status is still F1
C3 - offered you a job but you need to know what to do
you can have C3 file for a new H1. There is no such thing as "H1 Transfer". Since you have a approved H1 petition with C2, you are already counted in the cap. However since that was without COS, it has not changed your status. You are still on F1. The paystubs are provided with the so called "transfer" to document to USCIS that the prospective employee has maintained valid status with previous employer. Since you could not work with C2 yet, there is no need to show paystubs from C2 with C3's H1 petition.
