my lawyer said that the same person cannot have 2 pending application for 485...
When u apply 485 a ALIEN # is assigned to u whether u r dependent or Primary applicant....and u cannot have 2 alien #'s
This is my opinion based on my understanding. This is not a legal advice.
One may have alien# prior to filing of I-485 application and having (or not having) alien# has nothing to do with I-485.
One can file only one I-485 application. However, some argue that one can file for I-485 and CP based on 2 different basis.
The important thing is that underlying basis for I-485 can be changed without re-filing of I-485. I don't understand the confusion. This is simple and not a complex issue.
Please spend some time in researching.

PD, ND, RD - None of these matter at all. You will ultimately have to go through whatever is in your destiny. The July Fiasco is ample evidence of that. Because of this fiasco people who filed in 2006 may get their GCs before people in 2001, so no date matters in the end.

We have a different situation. We have filed our I 140 right now along with 485 but since my old labor has an earlier date and it got approved I want to file my I 140 again based on the old labor. Please advise as this earlier post suggest that I 140 should be approved. My earlier I 140 is still pending.

As far as my knowledge is concerned, you can get H1B transfer. But the approved
I-797 H1B notice will not contain I-94 at the bottom. Instead it contains consular notification. That means, you have to get H1B transfer stamped in your passport.
One thing I am not clear is, whether you can start working on H1B as soon as it was approved or you need to get stamped and then start working?
Please let me know if someone knows the answer. Or you can ask the lawer about this.

Last week I received email with RFE on my pending I-485 case.., this was little surprising considering RFE is issued after almost 4 months since I have moved to a new employment in a new location last sep08. LUD got updated after I filed for change of address in Oct08.
When I changed my employment I did not file for AC 21 documentation to USCIS. So far I have not received any mail from USCIS. Do the RFE details go to attorney or to myself. I am planning using the same same attorney who filed my GC to respond to this RFE..
Pls let me know if you any ideas or experiences with RFE's

-How many days we have to respond to this RFE

My wife recently received H1B visa approval. The H1 visa will be effective from October 1, 2007. So she is currently on H4 visa and don not have social security number. My question is, can she go ahead apply for the SSN now or she needs to wait until October 1.
I already tried calling Social Security office, but the customer rep keeps saying that bring you green card. :( . I gave up trying to explain her my situation after a while. Any help would be appreciated.

And the law is same for everybody. You just cannot file 485 when an immediate visa number is not available to you (as per the visa bulletin). There is absolutely no confusion here.
So, only your daughter's applications says rejected. Your + wife's AOS application is "receipted". Am I correct? Since your daughter is a "derivative" applicant, can you not file any time even after August 17 since the primary application is pending? Experts, what say?
