I can't wait to share this my dear IV friends, I got a CRIS notice today Sunday, that "Approval notice sent". To be very honest this is like green card to me, as I can invoke AC21. Also, with God's grace I've couple of offers in the pipeline, only to be delayed due to I-140 status.
On December 12, 2008, we mailed you a notice that we have approved this I140 IMMIGRANT PETITION FOR ALIEN WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
I really thank each one of you and wish you success in the immigration process.
I will be in the rally at DC in 2009 for sure.

Instead of going after CNN, they need to go after sponsors. As sponsors
pull the plug, CNN who is after profits will also pull the plug.
For sponsors to pull the plug, viewers [that is WE the people] should stop watching the channel. High viewership numbers attracts sponsors/advertisers. The ad ppl don't care what the content of the program is - all they need to know is that the program is "popular". That forms a nice circle, doesn't it - everything begins with us and ends with us ;)

My Wife's 485 status is same ... Document mailed to applicant. We have never received the document. When we called customer service they said the letter is for finger printing, again the same person said that she sees the finger printing on my wife's file and so can be ignored. Still the status shows the same.

Hi,
I went through the IV forums to gather the list of documents that I had to send for AP efiling. I compiled the following list of documents and sent these out as supporting documents for my wife's AP renewal application -
1. I-131 E-File Confirmation Receipt
2. Copy, USCIS Receipt for e-filed I-131
3. Evidence of Adjustment of Status filing
- Receipt Notice of I-485 application.
4. Copy, Previous Advanced Parole issued.
5. Copy, Official Photo Identity Document(s) with Photo, Name and Date of Birth
- Biographic Page of Passport.
- Employment Authorization Document (both sides)
- State Drivers License
6. Copy, Document Issued by USCIS Showing Present Status
- I-94
7. 2 copies of Passport Photograph
I have received an RFE on this. This is the what I got -
"Evidence of Eligibility: Submit a copy of your approval notice (Notice of Action, Form I-797) or receipt notice (Form I-797C) for Form I140, or Form I360 or Form I526. If you have filed the I485 as a derivative alien, submit spouse's or parent's I797C for his/her I-485 and the I-797 for his/her approved or pending I140, I360, or I526."
I am the primary applicant still on my H1B (7th year). My wife is working and on EAD. I guess I should have sent my 485 receipt, 140 approval, EAD etc. too and could have avoided this RFE. From the above statement, I infer that I should be sending the following documents now -
1. 'I797, Notice of Action - Approval Notice' for my approved I140
2. 'I797, Notice of Action - Receipt Notice' for my I-485 application.
Please let me know if this list of documents would suffice the RFE or if I need to send anything else like the following -

4. Copy of my I-94
5. Copy of my Drivers License

Yes, I work for a large corporation and also have a MS degree from US with over 6yrs experience in the company. My attorney filed in wrong category at that time and since then i am stuck in EB3 category even though i was eligible for EB2. I want to at least try instead of not doing anything, So gathering info on various options. I really appreciate IV efforts to help all categories but i want to pursue porting also. I support IV efforts and also contributed to the DC event as i couldn't travel.
Also, I am a little confused as i thought we can file multiple PERM LC depending on job duties even though you may have a pending I485 application. Does this mean, I won't be able to file in EB2 category even though i join a different large company? What are DOL regulations? Do the job responsibilities need to be 50% different or something and if so will it not affect your pending I485?
You can file an EB2 Perm with appropriate duties as long as the position qualifies for it and your duties are significantly different from your EB3 petition. Don't trust any attorney blindly. When in doubt check with a reputed attorney different from your company attorney at your expense if needed. You can always try an EB2 perm from a different company without much issues. If current attorney/company is trying to hold you back from going EB2 route, find another company to do that. That is next logical step.

i UDERSTAND YOUR PAIN. i HAD TO GO THROUGH THAT LAST YEAR WHEN I APPLIED FOR MY EAD. I MADE MANY CALLS AND ON ONE LUCKY DAY I AM ABLE TO CATCH A GOOD IO WHO HELPED TO GET MY APPLICATION FROM SOME DUST ROOM ( THEY CALL IT STORAGE ROOM). KEEP CALLING USING POJ METHOD.

Could someone please tell how much are the BCIS fee for H1B extension ? Is there any Employer training fee associated with the extension also or only with the first time H1-B filing ? If so how much is it ?

The risk with applying now is she may have to face deportation if her history comes under close examination. But if she gets lucky they may overlook this altogether. The fact that she was denied entry before I dont think is that important. They may not have that information- their systems are not that connected. Fact is she is on US soil. She came in legally. Problem is, she is now illegal because she overstayed.
Its your call.
But calling white house may not be all that helpful. And... no the president does not pick up the phone sometimes. :)
All calls are screened before they are forwarded to the presidents extension.

The guys who are still filing as it is ok with some law gurus... should also get same benefit .. after all they are being 'guided' by the the law champions.. who are supposed to be knowing law. all the postings from murthy,rajeev khanna about still ok on filing in july.. should be preserved... as a proof that they guided /misguided us. I do not agree. Employer working with attorney directly on PERM does not cause an abuse.
Infact at PERM stage, it is the employer who should infact take the lead. PERM and I-140 are employer filings, and attorney should really be representing the employer for most part and some part for the employee.
Also private firms and sole-proprietorships might prefer not to reveal the salary details of all its employees, expenses and net profits to the employee. If they work with the attorney, they can reveal the information just to USCIS, and not to employees. So you cannot judge the employer abuse just because he dont want to handover all the comapny financial paperwork to an employee.
I also mentioned that, make your judgement on whether to continue with that employer, since you may need full support from employer at many stages.
I agree that, the employee should get the required paperwork he is supposed to keep. And H1B full filing paperwork is one of them. I am sure the H1B filing paperwork will have some high level financial report of the company.

So, do we get receipt number and FP notice simultaneously or do we get FP notice after some days/months? If we get after some days/months of rececipt notice, then what we can do is "we will give address of our employer, so that employer will get the receipt, and when we move we can do change of address so that FP notice will come to my new address".. Is this possible?

Say I am on h1b and wife is also on h1b. I am in my 7th year extension with a 140 approved.
I get Layed off.
Can I change to h4 and look for jobs (say it takes 3 months) and get a 3 year h1b extension based on approved i 140 and then get back into the h1b? Will I be subjected to the quota?
The memo says, those already in h1b status who have maintained legal status can use their h1b time that is left and can also get a h1b extension based on a approved 140.
Is such a thing possible?
