    There are a ton of activities and action items for people interested in.
    Pick one and get busy. If you do not like to write letter/s, pick something else.

    1) Write an administrative fixes letter to WH (This is a carefully thought out action item, there is a strategy involved with this.)
    2) Write letters to the media, Press, blogs, writers, reporters. Follow up with them, encourage and ask them to write about IV and the community.
    If you do not like to write,
    3) Call media reporters and meet them
    4) Call Lawmakers and talk to them, ask to meet them. Schedule a time and meet them.
    5) Organise other members to form a group to meet your local congressman/woman, house rep or Senator.
    Get help from your state chapter, if you are away from a state chapter, do it yourself.
    6) Bring awareness, encourage your friends and relatives to join IV and participate.
    7) Participate in a funds drive, ask for donations for IV.
    8) Think of creative ways to generate funds for IV.
    9) Blogs or other websites that can generate attention and awareness of the plight of Legal immigrant community.

    Liked your points. We are done with writing letters to WH. The deadline of March 1st is over. Whats the next action item for all state chapters.

    Pappu, I believe the best transparency on both DOS & USCIS part would be to release the allotted vs actual consumption of immigrant visa numbers on a monthly basis. Much like a corporation releases their balance sheet. Anything less would only be opacity as opposed to transparency.

    Don't know when we are going get that from these guys.

    You may need it for stamping your visa in the future. They may ask you all the I-797's then.
    Secondly, I guess I don't understand why you need to comply with what they are asking. Are they offering you experience letter in lieu of I-797?

    Any degree gotten while on job is not considered by USCIS, especially if the employer pays for it. The logic behind this is that if they hire an american in an EB3 kind of job and then he gets a degree while working, he should be able to fillin the eb2 position. And if you work for a small desi company, things will get further difficult as they have to fill the eb3 position otherwise the initial eb3 application itself is conisdered fraud. The only case that online degree can help is if the employee changes job.Hope this gets through your skull.

    1) There is no law that a degree gotten while on job or paid by employer will not be considered. I challenge you to cite a law . What law says is "experience" gained with the employer is not counted. Hope I need not explain you that Experience and Education are two different thing though both start with E :)

    2) It is never easy to move from EB3 to EB2 with the same employer. It needs a significantly different role. But that is a tad different than "All online degrees are useless " argument .

    3) OP did not mention about changing or not changing job.

    4) Your swinging between "online degree are useless" and "degree gotten while on job is not considered by USCIS" just shows that you are clueless on what you are blabbering .

    You need to come out of your GC depression/frustration before you speak.

    99 % lawyer will take you for a ride & will always delay your simple applications & will present you funny bills . Please select the one, whom you can approach physically for follow up & ask him before signing that he will be available on the phone etc. Do not sign a long all inclusive contract for complete green card processing. Negotiate clear step wise contarct ... like one for preparing & submitting correct Labor application. If there are any querries... they can always be answered with out a problem all applications are always approved after few exchange of letters. Negotiate clear terms for firing the lawyer during the process. DO NOT agree to pay hourly rate of the lawyer to pay for his time spent on half complete assignment. Mine ripped me off this way. Release all the ads yourself NOT through lawyer... they rip you off big time. I-140 & I-485 are very easy steps & you can do it yourself. You will be better off this way. In fact, I did my own PERM labor myseself after my lawyer ( third moron / crook I have hired) screwed up & I got it approved in 45 days. In fact try to find some paralegal guy working in any lawyer's office & pay him for his advise & do the process yourself.

    I have been dealing with these lawyers for last 4 years & have got stuck in the retrogression ONLY because of them.

    Looking to resolve a messy immigration tangle, the U.S. government is close to announcing that it will accept at least some applications for work-based green cards that were filed by thousands of skilled workers in early July at the government's invitation and then abruptly rejected.

    Tens of thousands of skilled workers, many of them in the U.S. on temporary H1B visas, responded to an official invitation, in a June 12 "visa bulletin" issued by the State Department, to take the final step in July toward attaining U.S. permanent residency. That sent workers, their families and their employers scrambling to compile paperwork and meet other requirements such as medical exams. Normally, eligible employment-sponsored workers wait years for their numbers to be called.

    Then, July 2, as applications poured into processing centers, the State Department announced in a bulletin "update" that no employment-based immigrant visas were left for the fiscal year ending Sept. 30 because of "sudden backlog reduction" by U.S. Citizenship and Immigration Services. USCIS announced it would reject applications that it received.

    People familiar with the situation say that officials are working out the final details of a plan that would at least partially rectify the problem.

    It isn't clear, however, whether the immigration agency will now accept all applications and process them later, accept only those that have arrived, or come up with some other approach.

    The July 2 decision provoked outrage among immigration lawyers, foreign workers and their employers. July 5, Microsoft Corp. announced that it plans soon to open a software-development center in Vancouver, Canada, with a view to "recruit and retain highly skilled people affected by immigration issues in the U.S." The announcement sent a clear signal to the government of the high-tech industry's dissatisfaction with the visa situation.

    July 6, a large Chicago immigration law firm filed a lawsuit seeking class-action status against the government. Separately, the American Immigration Law Foundation, a nonprofit group, said it will file this week its own suit seeking class-action status.

    Meanwhile, disgruntled green-card applicants cried foul, saying they had been unfairly treated by the government despite playing by the rules.

    July 10, they registered their disappointment at the immigration system by dispatching hundreds of flower bouquets to the office of U.S. Citizenship and Immigration Services chief Emilio Gonzalez.

    The next day, Rep. Zoe Lofgren (D-Calif.), whose district includes Silicon Valley, sent a letter to Secretary of Homeland Security Michael Chertoff requesting "all correspondence, emails, memoranda, notes, field guidance or other documentation" leading to the immigration system's about-face July 2.

    The problem may have resulted from a communications breakdown between the State Department, which issues a monthly bulletin detailing who is eligible to file a green-card application, and USCIS, which processes the visa applications. The State Department has said that its role is to ensure that every visa slot available is used. In the past, however, the immigration agency has failed to use all of the slots.

    actually its not that simple. I have been on and off tracking EB immigration for almost 8 years now, and in every timeperiod there have been bottlenecks. The bottlenecks have moved around, but the process overall has remained screwed up.

    LC used to take many many years, then PERM was brought in to speed things up. PERM was very fast in 2005/2006, not its all bogged down in audits again. I-140 approval used to take 18 months, then premium processing came, and now again thats gone, and we are back to 12-18 months. Pre-retrogression people would get stuck in namecheck, now that the name-check requirement has gone, dates (esp EB3-India) are not moving fast. And even if they do (EB2-india Aug/Sept) approvals are not flowing in fast enough (NSC especially)

    I agree with you for the most part. At this point, as you said in your post, most other issues are towards improvements, retrogression still sucks!:eek:

    What are planning now that you have your green card ? How has it improved your lot personally and professionally ? How do you plan on capitalizing on your green card (apart from the fact that you can take up fulltime opportunities) ? For the sake of heavens, please don't mention how you plan on incorporating and file H1B visas. I have nothing personal against incorporating, I am incorporating myself to be able to do corp-to-corp contracts.

    Coming down to me, I have a masters in comp eng from an approximately 50 ranked college, as ranked by usnews.com. I also have six years of supporting infrastructure environments. I have solid references at linkedin.com. I have coded at topcoder.com but my rating is in the bottom 10% as I lacked the will to spend time and energy. I really like to work for a startup in California. I recently failed a written interview with a startup with a few founders of Indian descent. I will continue looking. I am also looking for better paying SOA contracts. Personally, I want to spend more time meditating and connect to God. I believe each thought affects the whole world. I believe in Karma. At work I fix issues which no one has brought up which I wouldn't have a few years ago. I am at a point in life where I realize money doesn't buy happiness and, at its very best, a minor convenience. Being who I am and what I stand for has become more important to me. I am enjoying listening to classical music in the car. I also listen to hip-hop music on my computer (my favorites are method man, wutang, nas, black attack and eminem).

    This is just dumb uscis programmers at work. Pure translation "Document mailed to applicant" = Document Ordered or Oath Ceremony.

    I was in the same boat during last September when my PD was current. It was a crazy time as I recall, many late PDs were getting approved. Funny that I was really scared I might get my approval that time! ; )

    FTJ process based on my search that time was relatively tedious which could take atleast a year or so. NSC processing time for I-824 was about 8-9 months then. It did not make any sense to me to get separated for a year right after marriage.

    I called USCIS to see what were the options available to me including the withdrawal of my I-485 (zero risk option). I was fortunate to get a very informative and nice Rep on the other side. I explained her my situation that I was getting married later that year. She looked into my file and said there was no IO assigned to my case and it will take atleast another 3 to 4 months for that to happen. It would be safe for me to travel and be back in that time period.

    My wife came with me on H4 late last year. I got an RFE last month to update my G-325A along with change in Marital Status. I included my Wife's name in the G-325, along with date of marriage and sent supporting Docs with it. But she cannot file the derivative I-485 until my PD is current, So we cannot avail the EAD/AP benefits until then. :(

    My guess based on the current Pre-adjudication thing (or whatever it is !) and the narrow processing windows there are better options available now. Hopefully people wont get randomly approved even if your PD gets current . Well thats what logic tells... but then we are talking bout USCIS.

    In your GC process, You have invested a lot of time,money and effort. Not to mention the sacrifices and loads n loads of stress. Though we have built some sheer mental stamina to deal with this, I would suggest you to think twice,thrice... N times before withdrawing and starting over.

    One thing I learn from USCIS is that as an organization as a whole they may seem irrational, but as people they are very reasonable based on my experience. Give a call to USCIS, try to get hold of a rep or schedule an Infopass appt. There is nothing better than openly talking about your situation to an informative officer. Then make an informative and calculated risk.

    My very best wishes for all you on the account of your Marriages. It is a time to be happy and not get too worried. After all once married you aint gonna be happy anyway ; ) Enjoy the little time left !

    That's a great input - so did you really give them any letter from new EMPLOYER ( whom you ported with AC21) which said that your future Job will pay you 150K/160K instead of 75K stated in LC
    OR
    you just gave them the paystubs when the RFE came before 485 ?

    My LCA salary was 75K/Year 3 years ago, but I submitted pay stubs 120% > LCA when I filed 485 and my petition was approved with out any issue...

    2 main issues

    1) Major delays in LC pre PERM. My PD is August 2001 and my LC was approved in October 2005. What took 4 yrs now takes 1-2 months. Different states had different rules some went through and some got stuck - very unfair process. Some con ass consulting companies were just starting shell offices in states with faster LC without actual operations there just for faster LC.

    2) USCIS is approving I 485's based on RD and not PD. So you have situation where ppl with later PD have 485 processed and waiting on PD to get current and those with old PD still waiting for their files to be reviewed. USCIS needs to start approving cases based on PD and not RD. So someone with old PD and new RD should take prescedence over someone with old RD but newer PD.

    c.) anyone in US for more than 7-10 yes..automatically qualifies for EAD/GC



    I like it. If a person has worked for 10 years and paid tax continuously that is a great contribution to country. Actually he should be paid back with citizenship, at least by GC.
