What is this CP thing. I thought it would be only regular AOS. Can some one please help me understand how this works.
thanks in advance
CP = Consular Processing (I-485 filed from outside US)
AOS = Adjustment of Status (I-485 filed from US with EAD/AP benefits)

The unavailability of visa numbers shouldn't stop USCIS from denying 485s, should it? Anybody aware of such cases when they denied 485 (or at least sent a NOID) while visa numbers were not available for the applicant? If yes, then yes, they do process (pre-adjudicate) 485 applications while visa numbers are not available, if no, then no.

I think all members before responding to any threads need to get the diggs done. That will be a good way to get these articles up.

I did not see anywhere that color copies of any document (except color photos) is a must, and will send standard B/W photocopies.
I have another question: There seems to be some confusion about the "Date" (of application of last EAD) that one should write on the form. Someone on this forum said he made a mistake (http://immigrationvoice.org/forum/showthread.php?t=18886) (3rd entry in this thread) by putting the receipt date, which in my case will be July 2, '07 (yes, I am a July 2 filer). If this is indeed a mistake, what should we write instead? Is it the receipt notice date (Aug 27, '07)? Anyone knows about this?
Also, paper filing apparently avoids getting another FP. But, like so many others, I never got the notice for my first FP, even after 10 months. Hopefully this will not complicate the renewal. Anyone here in this boat?
Thanks for reading and responding!

Hi all,
I read that annual greencard quotas are distributed as percentages among the applicable countries - 7% per country if Im not mistaken?
My question is...
Where can I find out how many (in terms of units, roughly) greencards are allocated to my country (UK) and how many are applied for each year?
Indeed, I would imagine that this is of massive importance when it comes to longterm planning. Being from India or China, somewhere with massive population and development, must be a serious disadvantage when it comes to getting priority dates.
Thanks,
RM

Dear friends, did anyone visit Hawaii? I am trying to find out if you need to have passport/visa to visit Hawaii. I know it is an outlying territory of US and so can you travel with valid ID/drivers license instead of carrying passport? I don't have a H1 stamped in my passport.
I went to hawaii. Its like going to continental US. no passport required. Only ID required as with any domestic air travel

Obama is using "trial and error" technique, do not have real political game playing experience. He is learning on the job. Empty rhetoric. Some may work, surely not all.

can the employer revoke i-140 after the 180 days period of filing 485? he might but if there are 20-30 employees, will he file to revoke all of them?
Of course an employer can revoke any petition that is theirs such as I-140 or H1. Its like asking can an employer rescind an offer letter or abolish a position.
But if your I-140 is approved and it is over 180 days since your I-485 has been pending, it should not impact your I-485 at all. I said should because we have seen some forum members stating that some people got NOID or denial due to this. But in most cases, they filed MTRs and got their denials revoked :)

There is only one way out - find a new job . What your employer is doing is how the H1 process is designed to be. If the employer does not have a job for his employee he is supposed to inform the INS by law that he is withdrawing the H1 and terminate your employment. Your employer was kind enough to not withdraw your H1 even after a month .
If you want to continue on H1 you can try transferring your H1 to another employer before he revokes this H1 . You will need current paystubs for that or at least an explanation of the missing paystubs for the last one month.

Very interesting and inspiring article. Especially what it says about the immigrant entrepreneurs
"Immigrant entrepreneurs' companies employed 450,000 workers and generated USD 52 billion in sales in 2005, according to the survey."

You need to have better understanding of immigration laws. Until you get that, don't spread false information.

Thanks! Thsi makes it very clear --
(from Murthy site)
"Even though the visa stamp will contain the name of the prior H1B employer, it may be used at the time of entering the United States with the H1B petition approval of the subsequent H1B employer / sponsor, as long as the H1B employee is eligible for entry in H1B status. The important thing to remember here is to request that the POE Inspector stamp the I-94 card valid until the date of the H1B approval notice with the present employer and not the earlier visa validity date stamped in the passport with the earlier employer."

Sorry to hear about u. Are you in IT. If your job discription on H1b is related to IT and ur higher studies were related to some other field(like mechanical, electrical etc...) then Consulate ask loads of questions. Otherwise there shdn't be any problem.

It may just be possible for you to get him a GC too, if you act now. Quickly find an established immigration attorney (nothing less will do) and check your options.
Good luck
