    Another soft LUD on the 485 on 11/26.

    This is the 3rd soft LUD on the 485 (11/24, 11/25, 11/26) post sending AC21 and G28N documentation.

    485 status still says Case received and Pending.

    I hope this isn't followed by a denial, I have to travel outside the country in 2 weeks and it would be nice to not have to worry about this.

    I thought that nobody in this forum thinks properly, but you came to the rescue.

    It seems that everytime you make a comment/opinion on somebody's comments, somebody will always fire back with a very nasty and inappropriate reply. I don't understand that. I thought IV is an open forum that you can exchange opinions, but it seems that everytime you make your own, people start to gang up on you if your opinion is against theirs, no matter how you phrase it properly.

    They can just reply in an educated way instead of abusing or using nasty and harsh words.

    But you are thinking member.

    Keep it that way.

    I think most of the guys n gals will be busy with their paper work for I-485, 765 and 131. I am guessing once the dust settles most of them will come back and contribute generously.

    I know most of you know the magnitude of impact IV has in the decision of the reversal of July 2nd update.I am in my 8th year of H1B and I wish IV has arrived 2 to 3 years back, but I am happy better late than never.

    Thank you IV and I very much appreciate you keeping the cool when people started second guessing after the AILA update that the situation is 'Fluid'.

    I have just talked local Congresswoman's Office and I have talked to a staff member for 1 hour and she is helping me. She is going to call NSC and get to the root cause of this problem.

    If you are reading this, do not lose hope. We have to try every avenue and knock every door that is open.

    In my area there is no Infopass appointment available before my departure. What is the difference between departing with approval notice in hand and

    with knowing that application has been approved but depart without the physical approval notice in hand before departure and get it aborad if my friend mail it to my place in abroad and later entering with that . Anybody could help in this situation with some advice.

    If you are beyond 6 years and I-485 denied then applicant is doomed weather you are in H1 or EAD. Only route is MTR. My attorney confirmed it.

    She suggest unless MTR get open. You should not even work to avoid the issues.

    So it does depend attorney to attorney. I don't think we have any case examples in either senarios. So bottom-line, do whatever you feel correct and make you happy. :)

    Personally, I think RG is seems more logical. If you use EAD your H1 becomes invalid. No one revokes but it happens. Similarly, H1 becomes invalid as underline petition get denied.


    Not really h1b is a different track all together. If 485 is denied and the denial is final - person is still free to work till h1b expires thats why lawyers say h1b is safer

    I'm telling them my condition, and I know there are lot of people in the same boat. Again you need to talk to the lawyer about GC cost. Emplyee can bear all the GC related cost.
    EAD/AP 360*2 + 305*3(Spouse + son) is almost 2K.
    If your facts are different put that in writing and send it to them. Please stop telling me my facts. Also I have no idea why you are on this thread, please ignore this thread if it doesn't apply to you...


    I suggest you talk to your lawyer first. The cost of Labor and I-140 should be borne by the employer as they are employer's petitions.



    2K for EAD and AP this year alone! Let us see how many people on this forum has spend that much on EAD and AP. Paying high legal fees is NOT a basis to seek remedy.



    That was your choice.



    H1/H4 and Green Card processing are not related to each other. H1 is for current job and GC is for the future job.

    c) Less porting from EB3->EB2

    If implemented may help the EB2-I/C backlog move faster. Probably USCIS's way of reducing the backlog!!

    deepimpact, shame on you to think like this. This is just one more of example of how ignorant the immigrant community is about the ground realities of these law changes in the employment-based immigration rules which includes H1B, L1s, EB apps etc.

    1. The neufield memo of Employer-employee relationship & giving not 3 years of H1B visas but in some cases depending on the contract 3 months of H1B visas.
    2. The fee hikes of H1B & L1 visas.
    3. Make EB1, EB2 etc more strict to make it almost impossible to get anymore EB2 apps approved. BTW there is nothing which stops them from issuing another memo to review all EB2/EB3 I-140 approval and revise the approvals & deny them if deemed necessary. What would you say then?

    You completely missed the point. Put the events in chronological order and you will realize why IV Core insists on meeting lawmakers. Pretty soon, there will be no avenues even with a lot of legitimate experience for an immigrant unless they end up winning nobel prizes....sorry there are not many nobel prize winners in this world and I have not met one so far.

    Anyway, hope others continue to meet the lawmakers leaving your EB2-EB3 divide to ask them for recapture and removal of country limits.

    For that only I am telling we need to teach a lesson. Take them once to court, and if we can get the judement once in our favour it will nail the coffin. If we lose, some one else try again in different court.

    Shan - I totally understand your frustration and where you are coming from. I had the same level of aggression when i first started participated in IV activities and I am sure, a lot of people want to pursue things in an aggressive manner.

    But lets calm down for a minute.

    The OP initially contacted IV after googling up and came across our threads and I spoke to him. He was frustrated with opening two MTRs and was looking into mandamus.

    I requested him to do the following - exhaust all adminisrative procedures first. Contact Ombudsman, Senators, Congressman, try all options.

    See - these kind of decisions are not easy and not not everyone understands this stuff.

    Once you go to court, it may take a couple of hearings and you will also have the other side arguing their cause.

    We must always remember that - we are in a civilised nation and people on the other side are willing to listen and try to resolve stuff in the best way possible
    - Lobbying, awareness etc.. are basic principles of IV .

    we are not here to teach someone a lesson or fight with someone - we are here because we want our issues resolved and we must work in the best possible way.

    Nevertheless - one must know how litigation also works in case that is the only option.

    I request people to please share their ideas and thoughts on how to tackle such issues.

    Let frustration not dictate your views. I understand that we all want issues to be resolved and get really aggressive on these forums - but lets just relax and think and see what is the best possible solution.
