I have both EB1B (OR) and NIW I-140 approved.
While NIW was approved without any problem, I got RFEs for OR application, and I needed to submit more recommendation letters and other supportive information. Let me know if you have any specific questions. I may be able to help.
For OR you would need around 5-6 letters from within the US and around a similar number internationally. The letter have to be from people/peers who know you professionally - advisers and post-doc mentors carry less weight. The international letter are needed to show that your work is internationally recognized.
Letter format -
Address to USCIS
(1st part) The letter writer introduce himself/herself and states how he/she knows you.
(2nd part) The letter write states why specific parts of your work (possibly refer to your articles) are substantial contributions to the field.
(3rd part) blurb requesting USCIS to give you permanent residence as you would be an asset to the US because of your superior scientific/artistic contributions.
(4th part) Get a resume from the letter writer to add to the letter - this helps.

Hi,
I recently graduated from a MBA program and have found a job with a top Management consulting firm, very interested in it. But, my I-485 is still pending, nearly 3 years now(I-140 approved). Not sure what my options are, would like to use EAD/AC21, but jobs are different (am a business systems analyst in my current role).
I will also be speaking with my immigration lawyer, but would appreciate your response/advice.

I also thought of converting to EB2 because EB2 was flying high and EB3 is left in dirt from last 2 years.
yes. In terms of retrogression, "further" actually means "backwards" :(
However it would be really odd if dates moved back from Jan 02 for EB2-India.
Anything upto Jan 2003 has been current for over an year now. As people were getting out of BEC I assume they were filing 485s and using up the numbers...
Cant believe there are many people with EB2 PD < Jan 02.

You should be ok. AC21 letter does not need to come from the employer. YOu or your lawyer can send it. Employment Verification letter is all that is needed from the new employer which they have agreed to provide so I think you should be just fine

Am i missing the point here or are you all forgetting that unless you have a future job offer, you will not get your green card.
while you can be unemployed on EAD you still need the future job offer to get your greencard and many of us got RFE to proof that we still have those.
If you go unemployed then you risk promopting the RFE and if you have no job letter your I485 will be rejected.
Also no they do not have to pay you anything beyond what is on the Labor cert paper, if they paid you more that was their prerogative, but legally they do not have to.
Be careful.
I understand you would like to be home for your wife, and believe me as a woman i appreciate man that is willing to to help like that, however make sure you do not get yourself in legal trouble with that.

Congrats! I know the feeling. My mom got a 10 yr visa almost 9 years ago and she has come twice so far but unfortunately my brother was refused when he applied with my mom. We still need to figure out how to get him a visa so he (and now my sis-in-law too) can come over to visit..

The problem is that most agents regard the I-94 expiry date as the holy grail for your current status. For people who are on AOS, the I-94 date does not technically mean anything since it is issued for only one year but you are fine with staying past that date since there is a pending AOS application.
However, I visited the USCIS office in Chicago in Nov to see if Deferred Inspections can renew the I-94 date. They refused and since my I-94 was expiring in Dec, they warned me against staying past that date since it would make me illegal. They suggested I go to the International Airport and see if they would do something. I know for a fact that the USCIS officers at the airport cannot change anything and didnt even bother going.
However, to keep things simple, I drove out to Detroit in early Dec, crossed the border into Canada, took a U-turn (almost literally) to reenter the US and got a new I-94 card valid for another year. I specifically asked about the validity of the I-94 if the AOS was still pending and they said that the I-94 date is the key and staying past that would get me in trouble. Given that driving to Detroit was a viable option for me, I was able to do it. If however, I was living far from any international border I honestly dont know what I would have done.
There clearly needs to be more guidelines around I-94 dates, i.e., when their validity matters and when not.

2) After he gets into the country, how do I apply to get him a green card (or do I do an I-130)? What is the process? I looked all over the USCIS website but I can't seem to find an option for going from an R-1 to a green card, even through family. (the option that says family assumes you've filed an I-130 but he'll already be in the country). Basically, I am confused =).

I have approved labor and I 140 in EB3 category. My PD is April 2003. I don't know how long it will take to file I 485. I am thinking to file GC in EB2 category. My employer is also ready to do so. But I don't know whether I am eligible or not. I have 3 years bachelors degree (B.Sc. in computer SC.) and 2 years Masters degree (Masters in Computer Management). I have 10 years of experience in IT. I am in USA since Oct 1999.
I talked to my Attorney today; she told me that you are not eligible because you need to have 4 years bachelors degree + 2 years of masters degree or 3 years bachelors + 3 years masters degree (like MCA degree)
I am asking this question because I just want second opinion.

Most desi consulting companies opened skeletal shops in SD (prior to perm) to get faster labor clearance. Closed the shops after introduction of perm and when INS started asking for details about the employees at each location etc... (I am not sure whether your company is a desi bodyshop).
If that is the case, your case may be in trouble. The labor market may have been tested in SD market. If your company can't substantiate that claim your case may be in jeopardy. I am not saying this to scare you. You may be prepared to address the outcome. What was RFE for ?

1. If you guys wish, live separately for a while and see if things improve.
2. Give him sufficient time to think over what he wish to do. Afterall he has been with you for a long time. (maybe he can apply for canadian PR, or find someone else to support his GC).
If you guys do something in haste you may have to repent for a long time. Treat each other fairly.

I advice you all to walk in to ASC locations.
I went to one ASC location as walk in. They asked me to go District office where I already tried with an Infopass appointment.
Then I tried at another ASC office, and pleaded them saying my dates are current, take my FP, then I can get my GC. That officer is nice, he took our FP and they were cleared and sent to USCIS yesterday.
I will say, try in at least 2 ASCs at least twice at each ASC. Infopass is waste.
I went in the morning around 8.30 and there were only 4 people for FP and that officer took our FP after 40 min phone / PC communication.
Good luck to all.

Hello All...
This is not a question of completely leaving to india...
I'm working on H1b right now and i have 2 and 1/2 years more of h1b in my hand and my I485 is pending for more than an year, I just thought of leaving to india for 7 - 10 months and be back on h1b as i have h1b styamping on my passport,,, can i do this..
The Main question is can we go outside the usa for an year when we have H1b stamped and working on h1b status and not using EAD and come back using h1b?. If the bulletin becomes current based on my priority date i will come back to USA..
This is not a question of completely leaving to india...
