Dont seen why intorducing a provision to recapture some time would run into problems...I think that would not....any way I think you guys should dicuss this option with the lobbying firm to see what they say...it will be some kind of a band aid for our agony...

I have requested for help in regards with how to address the ability to pay denial . I have recieved a lot of help for various members and also talking with attorney, here is what we are planning to do as far as the appeal is concern.
1 - Since my company was not paying the proffered wages from the year 2003 to 2006 ( in 2007 they are), my company is agreed to pay me the difference of the salary from the year 2003 in check and will right a statement as to why I didnt get the fully salary before.
2 - Company will provide the last 2-3 months of payroll statement which is more that a milliion dollar.
3 - An audited financial statement of 2007
4- My recent pay stubs
5 - My W2 from 2003-2006
6- Recommendation letter from the federal client where I am currently working, showing that how important services the company is providing at the federal agency and since I am the project manager.
This is the list of documents that we have come up with to apply for an appeal. IN the mean time I am also filing a new labor with another company under PERM. Since my h1b is expiring in June 2008, if the I-140 get approve during the MTR and doesnt go to appeal stage I will be set, else if it goes to appeal then I am planning to extend the H1 based on appeal and will transfer my h1 to the company where they are filing a new labor for me and file 1-140 from there hence starting from square one again.
I do want an advise from all of you if I am missing something that should file with the MTR/appeal. Any suggestion to improve my MTR/appeal filing is appriciated.

My Wife was on H4-B and completed masters.
Unfortunately we have chosen this consulting company A to file for H1-B. As you guessed, we have sent our papers in a hurry due to H1-B visa numbers going away like hot cakes.
What do you specifically mean by 'right side of the process' ?
My Wife still has an outstanding job offer from company B.
I am on H1-B and my wife is somewhere in between H1-B and H4-B
Except receipt number and few emails (which iam saving) and questionaire documents, i have nothing.
Issues with company A
1) Not sending us a copy of H1-B application
2) Does not tell us what the offer letter contains
3) Is not revealing the attorney who filed our application
4) Is not properly responding to emails asking the above forms.
5) Is delaying answering the query.
6) He just sent a receipt number and don't know, if it belongs to us.
7) Last time we spoke, he said he will ask the attorney to respond to the query.
What i did was
1) Paid company A for my H1-B
2) Sent my resume and completed questionaire.
3) Waiting for the H1-B approval.
How many of the points above, i can use to nail the company A?
Can i get some sort of justice without hiring a lawyer?
How many of those points mentioned above are of interest to labor dept and or USCIS to initiate an audit on company A?
Can i use this case to legally transfer from company A to company B without paystubs?

It means that your wife has a valid job offer and you didnot pay any money to the company and also your offer was genuine one but with the details you have given itseems not.
Some the Points you mentioned about the company reflects your personal mistakes. If i am not wrong your wife dont have job offer with company A and you just want them to file for H1 so that she can work in next fiscal year but after that she might have got a real job offer with Company B and you want to pursue that offer.
All the points you mentioned will not help your case with USCIS or DOl as your case is not a genuine case.
Once your wife H1 get approved then you can file her transfer with company B ...If you are lucky sometime they dont ask paystubs for initial period and even they ask paystubs then you can get them from company A as they have to legally do it and if they dont do it you can file complaint with DOl or USCIS.
You best bet is to wait until here H1B petition gets approved and then try to transfer to Company B

I am very confident if you take at least one infopass appointment for every week of August, u will get approved. I think u r more or less through. U just need to keep bugging USCIS every now and then - tht way they may look at your file before ppl who are ahead of u in the queue.

We are now looking to get an OCI for our 5 months old son (US Citizen)..but strangely saw this on the Indian consulate website... CGI SF Contents (http://www.cgisf.org/contents/view/47)
Q 6: Are minor children whose both parents are Indian citizens eligible for OCI?

So did something change in the last 5 years or so ?

Now, they have announced that OCI and PIO will be merged. So, talk to the SFO consulate to find out the latest rules.

This may absolutely never happen and things will be ok again, but it would only serve us good if we are prepared. Instead of putting our heads in the sand and hoping that this crisis will go away in a couple of months...let's face the challenge, understand the situation and plan ahead....
Hence - plan for the worst, hope for the best. We need to plan for the worst case scenario and hope for the best case scenario.
Regardless of your immigration status, here are some things you can do so that you can 'sleep peacefully':
1) Keep at least 3 months of food in stock. Buy from Costco, Sam's club wherever....just keep things at hand in case food disappears from your nearby store.
2) Keep 3 months of home supplies in stock - same reason.
3) Buy gold...buy bullion, gold bars, jewelery...anything. In case the $ diminishes greatly in value, you can barter using gold and you'll still be ok.
4) Keep costs really low. That new car you were going to buy, postpone it by at least 12 months. Shop from $ store or Thrift store or goodwill store. Its ok to buy from these stores. Rich people are already buying from it. Use coupons...lots of them. the priority date mentioned in my approved 140 was Nov-2006 but i had an another 140 approved in eb3(2003). I dont have any idea hows this happened or may be my lawyer did some priority date porting work.

These are great comments, and I agree with everyone in different ways. I have 2 comments right now:
1- Yes, we do need to focus on the September 18 rally to make it a big success, and then, on September 19 we need to immediately start planning for the 2nd rally. The Sept 18 rally will teach us many things, since it will be our 1st one. I am sure it will be a big success, but we need to factor people's memory into our efforts (people's memory is too short - For instance, see how now most people think of 9/11 only on the anniversary of 9/11 - We need to hold a 2nd rally in order to: 1.1 = Remind people of our cause and 1.2 = Make it bigger and better than the 1st one.
2 - Reading the comments here I now agree that a BIG TURNOUT is our biggest goal, so the 2nd rally will have to take place where most of us IV members live, which I believe is the San Francisco Bay Area.
Let's keep focusing on September 18 right now. We need to have a huge turnout! And let's start thinking about a 2nd rally. We've had huge success right now with the flowers campaign, the San Jose rally etc, we CANNOT STOP now. We need to push harder and bigger each time. The key to it all is to NOT STOP, let us not stop at one rally. We need to continue pushing until we achieve our ultimate goal, which is FAIRNESS. We are not seeking special treatment or a pardon for breaking the law like the illegal immigrants are. We are asking just for the right to be able to contribute to the U.S. economy without tons of red tape and abuse. Rosa Parks fought for fairness too, when she claimed what was fair (symbolically to be able to sit on any seat in a public bus) We are on the same boat as Ms. Parks, and the only way to show this to America is not to relent, not to stop, until they understand what we are going through (most people do not understand) and until we achieve a fix. Again, all we want is FAIRNESS. Are we going to stop after September 18?

I came here last year with a different company H1. I dont have any problem with the current employer but the company i am working is a direct client to American Business Solutions. Due to this they approach me to join them.
I am actually worried that if i dont join them they may cancel the contract....
