I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.
Has anybody done that.

Hi,
Am on H4 and applied for H1B in May 2006. Because of emergency, we need to travel out of US; got the approval on Sept 7th and returned to US on Sept 10th. I lost hopes of Change of Status petition approval(as one of my friend's COS petetion is rejected eventhough she didnot leave US during H1 process), but surprisingly when I received my papers today, it is approved with old I-94 number. Thank God.
Now, Can I go ahead and apply for SSN. Can they ask me to go for stamping as the I-94 on the approval notice is different from the current I-94 in the passport?

They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o

USCIS has announced revised filing instructions for numerous petitions, including its Form I-140 (Immigrant Petition for Alien Worker), Form I-130 (Petition for Alien Relative), and Form I-539 (Application to Extend/Change Non-Immigrant Status). The new forms instruct petitioners to file their applications at USCIS Lockbox facilities rather than at USCIS Service Centers.

I have a simple question. The total number of I-485s pending as per USCIS is around 220,000. If we have 130000 EB visas every year, will the backlog be cleared in just 2 years?
No. You are forgetting the new applications in categories that are not backlogged (i.e., EB1, and EB2-row). They will essentially come in front of most applications that are in queue in back-logged categories (EB3 and EB2-[IC]).

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.

Both cards should arrive to the address that CIS has on file for the couple. The wife's departure from the US should not affect this. However, she needs to have the card to return to the US, ideally. Hopefully husband can send her the card.

Can we go to USCIS office after 90 days of filing I-485 to get EAD? Also, does the 90 day counter starts once we file or when we get the receipt from USCIS. Please advice!

Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?
Means, they reviewd all cases wherever the VISA dates were allocated/available. As you are from India, you have thousands of cases ahead of you.

Try taking the main battery AND the "clock" battery out. Leave them out for at least 15 minutes [longer is fine]. Then re-insert clock battery and then main battery.
