Just as an example, this may be an anomaly, but I know this Australian Indian citizen, who has recently bought 2 houses in the LA Valley and is having no issues filling them with contractors so far (1 my friend), even in this economy. He works on SAP projects traveling on H1 , but is in Aussie land most of the time, with his family. The rent more than pays off his mortgage.
to buy another house (if it is not distress property / from auction) just to put it on rent is stupidity ..risk is good if it is calculated ..to take foolish risk is foolishness ..anyway that is me. In this Country land is virtually unlimited !!! demand is low (see immigration ..they give majority GC's to people when they are 50 - 60 years old) and those who are young have smaller families because of high cost of living, way of living.

I think if you one wants to eliminate or significantly reduce the number of H1B's or immigrant visas, then you can go ahead and label that person "anti-immigrant". I would be with you, saying that is definitely negative to America.
So far I haven't seen Lou Dobbs doing that though. All the time I watch the program I see that man bringing up legitimate concerns. Lou Dobbs is a hero for Americans. The fact is that in general, wages have been stagnated for the last five years. What I have seen Lou Dobbs bringing up is that H1B numbers should not be increased. Don't you think that is a fair and rational approach ? Tell me. Honestly, when I learned this provision that they want to increase H1B visas at 20% every year, that appeared quite of a stretch to me. I know where Senator Durbin stands on illegal immigration issue , he is totally for amnesty/legalization of illegal/undocumented people in the country. According to him its ok if someone is totally undocumented and stays here but its not ok if someone does consulting and documented and pays taxes while working and waiting for the green card to be approved. Isn't it height of hypocrosy?

If the legalization were to happen these are the kind of people who complain saying illegal aliens have slowed down our green card petetions. Members working for consulting companies can talk to their employers about this. Let us know their response.
The employers are not gonna be worried about it..
Many of these restrictions were passed for the L1 program some 1 year back.
I know many people on L1 still working at client sites and no one even saying peep about it...
This is what I heard from a friend who is a employee of a NYSE listed firm with 100+ million turnover...He and a few more on L1 raised this question to their company lawyer.. The company lawyer had many arguments to defend their position. For example 'If DOL raises a question, the company would say we have offices at multiple locations one at each client site..'There is a small army of lawyers on the company's retainer and they are not afraid at all...They told the L1 employees to calm down and leave it to them....There are many creative ways in which to structure the consulting deals and the law is worth the paper it is printed on.....
DOL is gonna have 200 more employees for the enforcement...200 is nothing frankly...Then they have to funded every year...May be congress would not fund the additional 200. Governments never have the will to go after the businesses....So the law would look very restrictive on paper and no real impact.....I know as a fact that the L1 restriction law had absolutely no impact...
The net scenario would really depend on what happens during the first year or so...Suppose USCIS starts denying applications and they deny 10K applications...Then 5K and more of these appeal the denial and in the end sue the USCIS ..Do not forget to remember that CIR is passed and the USCIS is loaded with the legalization workload...The appeals system and the immigration courts would get swamped with these cases...As long as the case is in the appeal or the court, they employee continues to work.....The employees would have problems with the Drivers license and like but some would stick it out...Once USCIS appeals system and courts system gets overloaded with the case load...USCIS and the US attorneys would lose their will power to try to enforce the law......
I do not know the details of judicial review for H1 denials and I did not see anything in this law curtailing the judicial review of H1B petitions...So a lot is subjective about the law.....Many laws never have their intended impact it just goes sits in some corner...

Its a problem when we speak out on our issues - USCIS is offended that we have issues and wants to come hard on us.
What do we do? I am fine with USCIS rejecting or approving my application but reject it or approve it without putting me on hold for 10 years. Is that too much to ask?
It is the resume fakers and document fakers and the rule breakers who should be afraid of reaching out to people. The reason why we are in the mess is because of the greedy employers and ignorant and equally greedy employees. Corporate Greed brought America down.
Do you guys look around at all of immigration.
EB people are generally the only non immigrant to immigratn class of people who are allowed to stay in USA while they wait for greencard.
Almost all others have to wait outside USA for many years and cannot take benefit of what this country has to offer.
You could be a phillipino brother/sister of US citizen and wait 23 years to get your number called.
You could be here from Liberia as temporary resident for the last 20 years and have to keep getting extensions for temporary status and one day it gets taken away from you.
Sorry to tell you but the way you guys define pain is not pain when it comes to most immigration matters when compares overall.

Please quantify your response. There are numerous hindu groups that have worked for the upliftment of many. There are certain right wing hindu groups that do that just like there are many right wing muslims groups that target the other communities. As for Jinnah, I wonder if there would pakistan if he was offered the PM or the home minister. It is a rheotrical question and I doubt there is a clear answer.
Hindus have pretty much killed the practice of Sati and I doubt there will ever be such abominable events. Atleast they looked at it and removed it and that is praise worthy. There is still work to be done with the caste sytem but it is slowly been taken down

Rather than turn tail for his last two years in the White House, Bush has used every remaining weapon in his depleted arsenal -- the veto, executive orders, the loyalty of Republicans in Congress -- to keep Democrats from getting their way.He has struck a combative pose, dashing hopes that he would be more accommodating in the wake of his party's drubbing in the 2006 midterm voting.
Bush's own second-term domestic agenda is a shambles: His ambitions to overhaul Social Security and immigration law are dead; plans to update his signature education program have foundered; few other initiatives are waiting in the wings.
But on a host of foreign and domestic policy issues, backed by a remarkably disciplined Republican Party in the House and Senate, Bush has been able to confound Democrats. It has been a source of great frustration to the party that came to power with sky-high expectations and the belief it had a mandate for change. And it is a vivid reminder of how much clout even a weakened president can have -- especially one as single-minded as Bush.
"We have custody of Congress, but we don't have control," said Rep. Howard L. Berman (D-Valley Village). "Bush has shown, time and again, that he's a very stubborn guy. November 2006 didn't change that."
Many Republicans have been surprised and impressed with Bush's continuing power -- even when he has used it to ends they disagreed with.
"At the beginning of the year, most of us viewed the president as having less control over the process than ever," said Rep. Michael N. Castle (R-Del.), a moderate who voted against Bush on healthcare, the budget and other issues. "But this year, he realized more goals than in a lot of the years when he had Republicans controlling Congress."
At a news conference Thursday after Congress adjourned for the year, Bush had kind words for much of Congress' work and did not gloat over his success in keeping Democrats' ambitions in check.
"What ended up happening was good for the country," he said.
Democrats blamed this year's congressional gridlock on Bush, but his inflexibility on key issues was just one factor.
Republican lawmakers showed scant interest in compromise. Democrats were riven by internal divisions. And Bush did little to unite rather than divide the factions on Capitol Hill. He did not much resemble the kind of politician he was as governor of Texas, when he forged a strong relationship with the Democratic lieutenant governor.
Immediately after the 2006 election, it looked as if Bush might offer Democrats an olive branch and set a more bipartisan tone. He let go controversial Defense Secretary Donald H. Rumsfeld. He called incoming House Speaker Nancy Pelosi (D-San Francisco) at home on Christmas. After years of ignoring congressional Democrats, he began inviting them by the dozen to the White House to hear them out.
But the honeymoon did not last long. Democrats were furious when, after an election they believed was a mandate to withdraw U.S. troops from Iraq, Bush in January announced a buildup. A few weeks later, he went around Congress and issued an executive order giving the White House greater control over the rules and policies issued by regulatory agencies. White House meetings with Democrats turned partisan -- and then petered out. Bush repeatedly reached for the bluntest of presidential tools -- the veto.
His first veto this year nixed a war spending bill that included a timetable for withdrawing from Iraq. Democrats' promise to press the issue all year lost steam after testimony in September from the top commander in Iraq, Army Gen. David H. Petraeus, instilled confidence in Republicans whose commitment to the war had grown shaky. Without more GOP defections, Democrats in the Senate were powerless to undercut Bush's war policy.
Bush also wielded his veto power to great effect on domestic issues.
He blocked Democratic efforts to expand stem cell research, a popular bill that had broad bipartisan support. The failed effort to override that veto provided a window onto a dynamic that was key to Bush's source of strength throughout the year: Many moderate Republicans parted ways with the president on the stem cell override vote -- as they later did on his veto of the children's health bill -- but there were enough conservatives who agreed with him to sustain his vetoes.
Bush issued a barrage of veto threats to curb Democrats' domestic spending plans -- an effort that helped him regain some favor among fiscal conservatives who had lambasted him for allowing the Republican-controlled Congress to jack up spending to record levels.
"Fiscal conservatives can see the president getting stronger on spending this year than in the previous six years," said Brian Riedl, a budget expert at the Heritage Foundation.
Democrats had wanted to add $22 billion to Bush's funding request. But he drew a line in the sand and guarded it for months. He vetoed a bill packed with spending for education, health and other popular programs. The final budget approved this week adhered to his overall spending limit -- and dropped riders on abortion and other issues he objected to. And it included the money for the Iraq war with no strings attached.
Bush also held the line against Democrats' efforts to raise taxes, which they proposed to offset the costs of new health spending, energy programs and a middle-class tax break. Faced with Bush's veto, Democrats could not enact taxes on such inviting targets as cigarettes, wealthy hedge-fund managers and big oil companies.
Bush's Republican allies were almost giddy with their unexpected success.
"Who would have thought a year ago that Democrats would have come down to the president's budget number, that we would be ending the year by funding the troops in Iraq and Afghanistan, and that we could complete the year without raising taxes on the American people?" said Senate Minority Leader Mitch McConnell (R-Ky.). Let us be honest. A lot of us who came through body shops had to pay lawyer fee or had to take a cut in pay. Many of us had to sit in the bench for a long time with out pay. At the end of the day, not all of us are the best and the brightest but we are ready to work harder than the average Joe. With or without us this country will go forward. We are here to get a greencard and to become part of the melting pot. Please admit it my friends. I fully understands why many Americans are against us. We simply take their job. Then we insult them. Then we say, if we go back the American economy will go to hell. The companies are here for cheap labor. The congressmen who support them are the biggest receivers of their contribution. That is the reality. Let us not forget that. :D

I was just reading all the posts which i did not get to read since morning when i left for work.
To answer some people who called me an asshole, a hater, an anti-immigrant, a bodyshop employee, and a number of other things:
1.) I graduated from one of the IITs in India, came to pursue my Masters in the same field in the 4th ranked university (for that field) in the US.
2.) Finished my Masters in 1.5 years and got 2 jobs through on-campus placements (one in my field, one not).
3.) Took the job that pertained to my field of study, been here ever since, company is the number 2 company in its area, and is a US establishment.
4.) I never paid a dime for my H1-B or my GC processing till date, it was all paid by the company.
5.) My company is very strict regarding the letter of the law, and so my GC processing was by the rule book, each and every detail (no fake resumes here).
6.) I get paid the same (actually about 2% more) compared to a US citizen at the same level/position in my organization.
7.) I have exactly the same medical/vacation/retirement benefits as a US citizen.
I did not get a chance to read my PMs but will do that shortly after supper. Yes, i am EB2, but a VALID one. I hope, in moments of clarity, people who are shouting and abusing can see that.
Yes, i do have an attorney and a paralegal i am talking to, and i will file this case in the proper arena. I am fed up and will do what i think is right. Meanwhile, for those who think porting is right, you are welcome to it. No one stopped you from challenging the law either.
You can talk here all you like, but i pray that your "bring it on" attitude survives till the point where this porting mess is banned by law.

I agree with all the posters here. I also went ahead and bought the house while on H1B. Me and my family are really happy with our decision.
I got 100% loan (80-20) with no PMI. both 30yrs fixed. You can try with Mortgage agents who would do better deal initially and may transfer loan to big companies later. I got it at 5.7% first and 7% second last year.

A very simple, dumbed down calculation to see which one trumps the other, buying or renting:
1. Home Cost: $300,000
2. Down: $ 30,000 (10% of 300k)
3. Mortgage: $270,000
4. Mortgage Interest/yr: $ 13,500 (5% of 270K)
5. Tax, Insurance, Maintenance /yr: $ 9,000 (3% of 300K)
6. Returns on Downpayment otherwise/yr: $ 3,000 (10% of 30K)

I'll take a home appraised and bought for 300K for my example. The numbers are basically self explanatory. Contrary to popular claim among those who are pro renting, I don't think I pay more than 3% for tax, insurance and maintenance combined (item# 5). Of course, I was wise enough to buy a home in good condition. But that number will change as the home gets older. Maintenance should not include any upgrades that you do, which is basically only "gravy" and based on owner's discretion. Item# 6; I am going with the average returns if you invested in S&P 500. Item# 7; is what a similar 300K home costs to rent. Item# 8; I have only taken 5% growth which is I think under normal market conditions is the growth you would see on your home. The principal payment has not been accounted for yet. I'll do it later.
Situation Rent:
If you rent, then your expense per year is item# 7 minus item# 6 = $15,000.
Of course, your capital of $30,000 is still earning compounded returns.

I think one needs to consider both cash flow and quality of life. Apartment living with kids is not very pleasant, a house with a yard is really the optimal scenario. Mortgage payments may be comparable with rent, depending on your location, but utility bills are greater in a house. Then there are tax issues, whereby you can deduct the interest paid, and you are also building equity.
It's very complex, and our immigration status is just one more complication. However, like the Bible says, "he that regardeth the wind shall not sow". I think if you are at that time of life and you are planning to settle in the USA just go ahead and do it. I did it in my second year of H1B and it is now 5 yrs later. I am now in 485 stage and in the meantime I have built some equity and have no regrets.

Sen. Obama's proposals to invest heavily in alternative energy will spur a lot of innovation and high-skilled immigrants can be a great part of that initiative. I would rather see piece meal approach like recapture, STEM, etc rather than the CIR, but will Sen Durbin let it happen?? If CIR 2007 is brought back then EB backlogs will further increase, remember the back logs created by the 245i applicants (in 2000) we are still recovering from that. High-skilled immigrants can only be benefited by bills like recapture, STEM, country quota removal, etc.

Legal base employment candidates never had any representation as far as I know of until Immigration voice was formed. The other groups had some organized activity.
From some of the postings I have seen from IV Core; I believe they know what they are doing. They seem to be getting right advice of when to go on offensive and when to be defensive.
It is difficult for candidates/people who only have five to six years of history in this country to know how the system works here; ie., what arguments work and what arguments don't and what other side will do in ruining your credibility if they are pushed.
Everyone wants their greencard and they try to find reasons which they think others will appreciate (whether they have much merit or not).

DOBBS: Well, we've got a couple of answers to go with here. Either they don't know, they won't give it to you, and if they do have it, which they now say they might have, it's going to cost you five grand to find out.

And why this Congress, this president -- well, to the degree in which they're not aiding and abetting in the effort, are tolerating this kind of incompetence is beyond me, and a whole lot of other folks, obviously, including you, Bill Tucker. "...BILL TUCKER, CNN CORRESPONDENT (voice over): Attorney John Miano had a simple request. He wanted to know how many H1B visas were issued in the years 2004, 2005. The government would not tell him.

JOHN MIANO, CO-FOUNDER, PROGRAMMERS GUILD: I filed Freedom of Information Act request to get copies -- electronic copies of the records and applications for H1B guest worker visas.
TUCKER: H1B visas are temporary guest worker visas which allow foreign workers with specialized skills to work in the United States. Miano's reasons for wanting to know the information are basic.
MIANO: We do not know how many of H1B visas are being issued each year. The second big question we would know is, who is getting these visas?
TUCKER: So, what was the government's response to his request? "We have completed our search for records responsive to your request but did not locate any." In other words, they lost the records.
The response came from the person in charge of handling Freedom of Information Act requests. We asked the USCIS for a clarification, and a spokesman told us, "The response was a mistake and the letter was sent in error."
The mistake came to their attention after LOU DOBBS TONIGHT asked them about it. The agency tells us that the information Miano was looking for could be available, but he would have to buy it for a fee of roughly $4,500 to $5,000.
The former director of the Office of Internal Affairs at USCIS finds it outrageous that the information isn't immediately available and points out that Congress has been asking for this information for six months.
MICHAEL MAXWELL, FMR. DIR. OF INTERNAL AFFAIRS, USCIS: If they are at all honest with the American public, we will see that there is a real problem with fraud in the H1B system, and it is being gamed by both terrorists and foreign agents.
TUCKER: The national security implications are obvious.

TUCKER: The USCIS is supposed to publish an annual report on the program, but no such report has been filed since (AUDIO GAP).
And the Senate's so-called immigration reform would nearly double the size of the H1B program, and, Lou, it would add additional guest worker programs for USCIS to manage.
