Hi to all,
Is there any one to help me.My question is iam on h4 visa status.I wana apply h1 under 2007 quota.But the problem is my husband's H1 is going to be expired this september 21st.Our emloyer applies new visa before one month of expiry.If i apply for h1 is it creates any problem.I would appreciate if any body helps.

Ask your husband's employer to apply for H1 & H4 little sooner. You can actually apply 6 months before expiry. This way you can get your H4 before your H1 gets processed. You want to make sure that your H1 gets approved after your H4.

So,
JKAYS94, does this mean that they are required to finish only RIR cases by that timeline (if so, why does their website not clarify this point? can we sue them for false information? ;) )? What about non-RIR cases? I guess we continue to wait in "no-man's-land" with no information about when our cases will be addressed by DOL? A really depressing thought!

you are right that there is a faint glimmer of hope. but it is so faint and so fragile that most likely nothing will happen in terms of CIR. which may be good too since there could be piecemeal legislation. I guess that the best way out would be to just increase visa numbers in all categories and have tough rules ..maybe only such a legislation will have support
I for one have given up hopes and my plan B has become plan A ..the only other hope is housing ..they need people to buy the vast inventory and maybe they will loosen immigration a bit ..but as I said ..all these are faint hopes and not something that you can depend on . (as everyone has pointed out ..NOTHING happens in election year ...and hence since health reform has stalled and since immi was not given priority over health ..immi reform is as good as dead) !!

Let me try to explain this, but keep in mind that anything and everything in USCIS is unpredictable!
You asked how is it possible to move the dates back to 2001 after approving cases from 2002 and 2003 in the last 2 months. Here's the answer:
The Cutoff date is set as the PD of the first pending application which is ready to be approved but can not be approved due to unavailability of a visa number.
"Ready to be approved" means all checks are cleared. If they set the PD to say 2003 and approved cases from 2003, that does not mean that ALL cases before that date are ready to be approved. Ssome of them may be stuck in name checks or other checks.. there could be thousands of guys from 2001 and 2002 stuck in various checks. Now after 2 months some of those stuck cases come out of those checks and are ready to be approved, the PD is calculated again and cut off is set to the date of the first application is ready but can not be approved due to unavailability of a visa number.
Assuming there are only 2 visa numbers available per month and they have the following applications pending
Month1
app1 : PD 1/1/2001 stuck in name check
app2 : PD 1/1/2001 stuck in name check
app3 : PD 1/1/2001
app4 : PD 1/1/2002 stuck in name check
app5 : PD 1/1/2002 stuck in name check
app6 : PD 1/1/2003
app7 : PD 1/1/2004
Since they have only visa numbers available for Month1, app3 and app6 can be approved and the cutoff is set to be 1/1/2004(Meaning that applications with PD before 1/1/2004 CAN BE (not WILL BE) approved.
Now they approved app3 and app6 and consumed all numbers available for Month1.

What you're saying is true. Since the American public is more sympathetic towards advanced degree holders than those who work for body-shoppers and Indian consulting firms, I'm assuming that the strategy is to let them be the spokespersons for IV to attract more attention and sympathy towards our cause.
Who do you think is better for IV's public image - A PhD in CS from Stanford who works at Google or a BTech from an unknown college from India working for XYZ Consulting?
I don't want to insult anyone or undermine anyone's worth to the US economy, merely want to highlight what would be the best strategy on IV's part by taking advantage of the public perception.
As if Advanced Deg holders are the only sufferers. Any way, its good news that our legal Immigration Community is getting noticed by someone. Best of luck.

I came here last year with a different company H1. I dont have any problem with the current employer but the company i am working is a direct client to American Business Solutions. Due to this they approach me to join them.

Does this mean that they will accept direct filing now?

Hi All,
First of all I would like to thank everybody on this forum for helping out with the Visitor Visa information.
As you might know from my previous threads my Parents visa was rejected twice from Mumbai Consulate in 2004 and 2005. My Parents and I were totally depressed and were having a tough time trying to figure out what is going wrong. After failing twice we were very worried about applying for third time but then we all thought of it as sheer gamble and luck and decided to apply.
I was the sponsorer for the trip and my father is retired and landlord. We wrote his occupation in DS-156 as retired and landlord.
This time we let my mother give the interview as my father keeps forgetting things due to age.
No documents were seen at all. The interview was in Hindi. They asked all basic questions to my mom
1) Why do you want to go?
For Toursim and to visit daughter and son-in-law
2) How long do you want to stay - 2 months
3) What does your daughter do - XXX in AAA company
4) What does your son-in-law do -- YYYY in BBB company
Thats is the visa was granted and we could not believe it. As it took us 5 years of suffering to get it. But keep hopes up and keep trying.
Enjoy man.. I can imagine how it feels. So when are they coming. Plan for summer.. I know you have done that already. If properly planned, between now and take off, its just 1 week.

I-140 was approved in 2008 by TSC, and I got email from USCIS recently that the I-140 was trasnferred from TSC to NSC. Now, the Case Status Online shows as "Current Status: This case is now pending at the office to which it was transferred" (at Initial Review). What does that mean? Is NSC going to process this approved case again and give decision on that?? Do I need to do anything at this point?

There are quite a few IV members whose priority is between Jan-Jun 2004(EB2-I). Lets see if USCIS gets the job done for these guys since they are current now....

There will be multiple simultaneous sessions to plan and coordinate all the four (4) events including every meeting with the lawmaker's office. Chapter Leaders are requested to be present at the Situation room for most part of the weekend. It's going to be lot of fun.....

If you are still hesitant about the rally, think again. You are going to be missing a lot. If you live within 300-400 miles of DC, its still not too late. Ask for 2 days off tommorow from your boss, and come to DC on Saturday and stay thru Tuesday afternoon.
You really really will regret missing this historic event.
